Notice

Deposit

All buyers must pay a credit/debit card deposit of £100 - and a non-refundable administration fee of £5 - at the point of registration in order to be authorised to bid online in the auction. The deposit will be taken from the card used to register for the auction.

Approval

Bidders will be pending approval until the deposit has been taken. For this reason please register for the auction as early as possible.

Payment

General Goods - for sucessful bidders payment will be taken from the credit or debit card automatically on the day of the sale. Credit card payments are subject to a 3% surcharge.

Vehicles - all succesful bidders will need to pay the balance by cash on collection or by bank transfer (collection can only be made once funds are cleared)

Collection

All lots must be collected by BEFORE 1PM THE DAY FOLLOWING THE AUCTION and booked in advance. Any goods not collected will be subject to a storage charge of £3 per Lot per night.

General Conditions of Sale

1.The conditions of sale and all other contents of any catalogue are subject to amendment by the Auctioneers by the posting of notices, by oral announcement made by the auctioneer prior to or during the sale, or by way of an agreement in writing signed by the parties concerned.

2.The Buyer in the sale agrees to be bound by the terms and conditions of Business. The highest bidder acknowledged as such by the auctioneer will be the Buyer. In the event of doubt on Auction World Ltd part as to the validity of any bid, the auctioneer will have absolute discretion to determine the successful bidder, cancel the sale or re-offer and re-sell the lot and/or take such other action as the auctioneer deems fit. Any bidder acting for any person who is not bidding shall be jointly and severally liable with that person for satisfaction of all obligations and liabilities hereunder. Without any liability to any prospective Buyers: Auction World Ltd may alter or withdraw any lots from the auction for any reason up to the moment at which the hammer falls in the relation to such lot(s).Where two or more consecutive lots are similar in quality and description offer a choice an any subsequent lots to the Buyer at the same price. Auction World Ltd, the seller or the agent acting on its behalf may bid for any lot or lots offered for sale at the auction.

3.The Buyer will pay to Auction World Ltd;

GENERAL GOODS - 15% (percent) on the Hammer price by the way of a Buyer’s premium plus a 3% online Buyers Premium for goods purchased via i-bidder. The buyers premium is also plus Vat for goods purchased through any means. The Buyer agrees that Auction World Ltd when acting as agent for the seller may also receive commission from the seller.

VEHICLES – The following Buyers Premium shall apply including Vat:

£0 - £499 £70 £500 - £999 £80 £1000 - £1999 £90 £2,000 - £4,999 £110 £5,000 + £120

Vehicles are subject to an extra 1% buyers premium when purchased via i-bidder.

4.Payments-The Buyer must forthwith identify himself and any principal or employer, together with appropriate means of identification to the Auctioneer, his servants or agents and if required to do so must pay 25% of the sale price forthwith by way of a deposit. The total sale price, less any such sum, must be paid to the Auctioneers at his office or elsewhere as he may direct. Payment in full shall be deemed not to have occurred until any negotiable instrument has been honoured in full (or cash has been paid) such payment to be made within the time specified in the sale notes or in default of the specification by 1 hour after the auction or on the next complete working day. Time of payment, shall be of the essence. The Buyer shall not be entitled to remove any lot from it’s position at the time of the sale until the purchase price of that and any other lot purchased at the auction has been paid in full and in default of payment as foresaid the Auctioneers shall have a lien upon all lots purchased by the Buyer during the same auction and shall be entitled to rescind the sale in respect of any lot or lots for which full payment is not made in due time, forfeit any deposit paid in respect of them, and resell the same without any right of compensation to the Buyer. The Auctioneer will also be entitled to charge interest upon any unpaid balance at the rate of 1% above Base rate from time to time and to charge for storage arising after the time. Any lots not collected and removed in full by the specified in the catalogue will be subject to a storage charge of £50 per day or part thereof, levied upon each invoice. All payments should be made in Pounds sterling accepted methods of payment are as follows:

Cash, Debit Card and Credit Card (subject to a surcharge of 3%). We DO NOT accept cheques.

5. Ownership of lots purchased- The ownership of the lot purchased will not pass to the Buyer until the Buyer has paid Auction World Ltd in full the Total Amount Due and Auction World Ltd has applied such payment to the lot and each such lot has been removed from the premises in its entirety.

6. Third Party Claim- Should any party claim possession of or title to all or part of a lot prior to its removal, the auctioneer reserves the right to rescind the sale thereof.

7. Transfer of Risk- Risk of loss and damage to any lot purchased shall pass to the Buyer upon the fall of the hammer. The Buyer is advised to affect any insurance it may consider necessary. Any duty of the auctioneer and/or Seller to deliver lots shall be deemed performed upon the fall of the hammer even if a lot is subsequently damaged and /or part thereof has been lost.

8. Buyer to remove- Assistance in the removal of any purchased lots by Auctioneers’ staff or the Sellers’ staff is undertaken solely as a courtesy to our customers and will be undertaken at the Auctioneers’ discretion. In no event will the Auctioneers or the Seller be liable for any loss or damage regardless of cause. (Whilst the Auctioneers or the Seller may provide details of removal contractors those named do not come with any recommendation)

9. Online Bidding – All buyers must pay a credit/debit card deposit of £100, and a non-refundable administration fee of £5, at the point of registration in order to be authorised to bid online. Credit Cards will be charged automatically on the day of the sale. All lots in our General Sales are subject to a 15% Buyers Premium, plus a 3% additional Buyers Premium for purchases made online, plus VAT - unless otherwise stated in the catalogue. In our vehicle Auctions the Buyers premium will vary and there will be an online 1% surcharge.

10. The Buyer - It is expressly brought to the Bidder’s attention that, at the time of sale, any item of plant, machinery or equipment contained in the lot(s) may not necessarily comply with the Health and safety at Work Etc act 1974. Environmental Protection Act 1990 or any other Act or Acts or regulations there under governing the use of that plant, machinery or equipment in a working environment. Successful Bidders for any such plant, machinery or equipment are hereby required to ensure that the use of any such plant and equipment at a place of work within the United Kingdom does not contravene such Act or Regulation there under applicable thereto.

It is expressly brought to the Bidder’s attention that certain types of plant or main service installations could contain blue or white asbestos, dangerous chemicals etc which, if not handled correctly during their removal from site, could be in breach of the Health and Safety at work Act 1974 section 2-9 and Control of Substances Hazardous to Health Regulations 1988(COSHH) or any other current legislations covering the use of such substances in a working environment.

All Buyers must comply with all current legislation and regulations in relation to the removal/disposal of waste including hazardous waste and may be required to satisfy Auction World Ltd in relation to their removal/disposal procedures. Where waste materials are removed all work must be undertaken by an approved and licensed contractor.

The Buyers or this designated removal contractor will not commence any work on his purchase until he has demonstrated to the Seller’s reasonable satisfaction that the requirements of all Health and Safety and CDM (Construction, Design & Management) Regulations applicable to the removal of the removal of the equipment have been fulfilled. The Seller’s decision on this is final.

The Auctioneer reserves the right to request that the buyer pays a bond in respect of the potential damage to the auction premises prior to commencing removal.

The Buyer’s understand that the stock may be damaged or faulty or incomplete. The Buyer expressly acknowledges that the stock may not be of satisfactory quality or fit for its purpose. Auction World gives no warranty or representation as to the quality or representation as to the quality or condition of the MERCHANDISE, nor is any warranty or representation to be taken to have been given. Items that are marked ‘Complete’, ‘Missing Fixings’ or ‘Parts Damaged/Missing’ are done so to the best of our knowledge. However, Auction World does not guarantee that ANY items are complete, unmarked or in working condition. All lots are purchased at the Buyer’s own risk.
