This is a public auction for the trade only.
and by entering in to this sale all bidders will be bound by this contract this includes bidding in person or online by simulcast and successfully winning bidders understand any item (new or used) fully prior to committing to bid / buy, the winning bidder acknowledges the terms of sale and bids / buys under the understanding that no item's are warranted, only if there is a valid manufactures warrantee remaining or otherwise stated in individual item description.

Lot type: Vehicles, motorcycles, plant and machinery or lots alike. 
All items are sold and accepted with the following understanding.

(1) Contract.
All bidders are entering in to a legally binding contract and except that when bidding they do so at there own risk and free will, Any bids submitted are valid and will be submitted to the vendor and may possibly be accepted at any given time throughout the auction. BIDDERS REMEMBER YOUR BID IS VALID, NO EXCEPTIONS !!!

(2) All bids submitted are taken as valid, vendors reserve the right to change any reserve price at anytime during any current live auction.
upon winning any lot(s) / item(s)  your invoice will follow by no later than the end of the next working day by email (electronic mail). all invoices are to be paid in full within 48 hours after the end of the auction. If you can not do this then PLEASE DO NOT BID!, Unless agreed with the auctioneer (in writing) before bidding with a £200 deposit by way of bank transfer (refundable if not successful within 24 hours after auction ends) but not refundable if the bidder / buyer for any reason pulls out of the sale and contract! 

(3) Auctioneer discretion.
The auctioneer may reserve the right to ask any bidder new or existing to capital asset remarketing for a £200 deposit if he / she feels necessary, non successful bidders will receive a deposit refund (by bank transfer) within 48 hours of the end of said auction / sale. 

(4) Viewing lots.
Viewing is always strongly advised before bidding on any lot / item, Failure to view any lot(s) intended bidders do so at there own risk and free will against the advise of capital asset remarketing. 

(5) Failure to view before bidding / winning a lot / item.
The bidder excepts all responsibility and makes this decision of there own choice and free will against the advice of capital asset remarketing.

(6) mechanical inspection of lot / item in person or by mechanic or expert. 
Capital asset remarketing allow (by strict appointment only, prior to committing to bid / buy and auction ending) potential buyers (before bidding) the opportunity to inspect the mechanical condition of lot(s) in person (with someone from the capital asset remarketing staff) , capital asset remarketing also allow inspection by RAC , AA, GREEN FLAG or any other independent mechanic or expert (subject to potential bidder / buyer paying for such inspections) capital asset remarketing / vendors except no responsibility for potential buyers not doing so and do so at there own risk and free will. 

(7) lot(s) Item(s) condition. 
It is strongly advised in all cases to inspect all item(s) / lot(s) in person or by a professional mechanic or expert (by strict appointment and prior to bidding and sale ending) any potential lot(s) / item(s), capital asset remarketing / vendors excepts no liability for any potential buyer choosing not to do so! And do so at there own risk and free will against the advise of capital asset remarketing. 

(8) Item testing.
(please refer to each individual item description, as it some lots may vary) 
Vehicles are only tested in the compounds where they will be stored and not on the public highway. 
(8.1) Runner. 
Lot(s) / item(s) stating Runner means that this lot / item starts and drives, and has been tested in such storage compound, Not on the public highway.
(8.2) Non Runner. 
Lot(s) / item(s) stating Non Runner means it will not start, for reasons unknown unless stated in item description
Capital asset remarketing / vendors except no responsibility and potential buyers bid / buy at there own risk.
(8.2.1) Non Runner. 
Capital asset remarketing does not allow mechanical inspection by potential buyers, mechanic / expert for Non Runners before or after bidding on that said lot / item until it as been removed from the property of collection. 
(8.2.2) No keys! 
Lot(s) / item(s) stating no keys can not be attempted to start,there for no inspection at all will be given to lots alike any item stated no keys are sold and must be accepted as a non runner.
(8.2.3) V car lots.
Any lot stating V car category means, that the vehicle as been damaged in the past. 
CAT A. Scrap only.
CAT B. braking only.
CAT C. damaged repaired. 
CAT D. lighter damaged repaired. 

(9) Lot(s) / Item(s) description.
The written description is set out as an outline to describe the said lot / item (For guidance purposes only, and shouldn’t be relied upon)
PLEASE NOTE: this is not a grading system of the said lot / item, Any accurate description is down to the potential buyer to investigate (in person by strict appointment prior to bidding / auction ending) .
(9.1) recorded mileage or hours.
Capital asset remarketing try to give as accurate description (for guildline purposes only) as possible, the following applies.
Description(s) stating 
Mileage warranted / correct : the mileage as been warranted by the vendor.
Mileage verified: the mileage can be checked back through vosa mot history check and there are no mileage discrepances.
Mileage un-verified: the item has no V5 Logbook to run a vosa mot history check and the intentional buyer should carry there own investigations to satisfy themselves, as the true mileage must be deemed unknown, history checks weather vosa mot history check or any other checks show the true mileage differs to the mileage shown on the odometer / clock and true mileage un-known. Any potential buyers should be aware of this at all times. 
Mileage not displayed: at anytime should mileage / hours not be displayed (for any reason) it is sold deemed mileage / hours totally unknown and not warranted.

(10) Photos and videos of lots. 
All photos are uploaded to show the body, interior and engine bay and as guide line of description.

Sunshine: Brighter / shiny
Cloudy: Darker / dull 
Rain: Wet / shiny
Capital Asset Remarketing strongly advise viewing at all times (prior to bidding and auction ending) Capital Asset Remarketing / vendors accept no responsibility for failure to do so and bidder / buyers do so at there own risk.

(11) Late payment fee’s & Storage fee’s.
failure to pay for lots within 48 hours after auction has ended (unless prior agreement has been made clear and verified in writing with Auctioneer) will result in late payment fee's of £12 + vat per day before the lot will be released.
Capital Asset Remarketing allow 5 Days after auction has ended for the bidder to collect, Failure to collect within 5 days will result in storage charges of £12 + vat per day.


(12) Collection of lot(s) / item(s). 
Collection of lot(s) / item(s) are by strict appointment only. 
(12.1) where necessary it's up to the buyer / collector to make sure that the item has valid road tax, a current mot in place and Insurance to be driven on the public highway, capital asset remarketing / vendor accepts no responsibility if the buyer / collector fails to do so! And do so at there own risk.
(12.2) when collecting items please be aware: you must have a HI-VIS fluorescent jacket for safety and stay with a member of staff at all times. 
(12.3) The buyer / collector must have a copy of there remittance invoice (paid) with them to release any item
(12.4) Buyer / Collector will be required to sign a release form before inspecting or removing any lot(s) or item(s) 
(12.5) buyers / collectors removing lot(s) or item(s) will be required to have a valid photographic proof of ID.
(Failure to comply could result in lot(s) / item(s) not being released. 

(13) Delivery.
Delivery can be arranged subject to fee’s, Contact Auctioneer for a quotation.

(14) Vendors.
Lot(s) / Item(s) maybe supplied from different sources and may be entered for auction by the following:
private owner, trader, company direct,finance company, trader part exchange, main dealer direct, finance repossession, salvage, seized, and others alike. THIS IS TRADE ONLY AUCTION, CAPITAL ASSET REMARKETING AND VENDORS DO NOT IMPLY ANY WARRANTEE OR GUARANTEES, ALL LOTS / ITEMS ARE DOWN TO THE POTENTIAL BUYER TO SATISFY THERES SELFS FULLY BEFORE BIDDING / COMMITTING TO BUY UNDER THESE WRITTEN TERMS & CONDITIONS.
CAPITAL ASSET REMARKETING AND VENDORS STATE: NO REFUNDS,REPLACEMENTS OR RE-NEGOTITION WILL BE OFFERED ON ANY LOT(S) / ITEM(S) (Unless mis-description is provided), SO LET IT BE KNOW THE ONUS FALLS UPON THE POTENTIAL BUYER TO SATISFY THERE SELVES FULLY PRIOR TO ENTERING ANY BIDS AND CONTRACT. 
(14.1) THIS IS A TRADE AUCTION ONLY.
Potential bidders should be aware that this auction is used for vendors to dispose of unwanted goods, whether company’s or individuals to dispose of unwanted, used, aged, over stock, damaged, spares or repairs, part exchange, non retail lots, items or goods! Let it be known that this is not a consumer sale! Capital asset remarketing or the vendors do not imply any guarantee or warranty, all investigations should be carried out by potential buyers to satisfy their selves before bidding as the onus is on them! 

(15) Bidders / Buyers.
All potential bidders can bid on line (by simlacast) or in person (contact auctioneer for more information) Bidders should be aware that this is not consumer sale for the purpose of the sales of goods act 1979. (As amended by the sales and supply of goods act 1994) and the Unfair contract terms act Regulations
1977 / 1999 and the buyer shall not seek to rely upon and conditions or warranties implied thereby. 

(16) Hammer price, VAT, Buyers premium. 
At the fall of the hammer the price you bid is the price you pay (plus buyers premium that can vary on each each individual lot / item, see lot / item for details) VAT is subject at the current rate of 20%, there are no renegotiations, offers or refunds! (Unless mis-description is provided)

(17) Documentation of lot(s) / item(s)
Item description will state if there is a V5 Logbook (IE, Yes, No, To Apply or to follow)
All lot(s) / item(s) come with an HPI report up on payment being received (by email prior to collection) or up on collection in person. Will be emailed unless requested hard copy! 
(17.1) Personal registration plates. 
some lot(s) / item(s) may have a personal registration number, lot description will suggest if the lot(s) / item(s) will be sold with any given private registration, If sold without, capital asset remarketing will require a NON REFUNDABLE deposit to remove any personal registration from any said item or lot (if not included in sale) no greater than £500 (if the lot is less than £2000 (hammer price) then deposit of 10%) but no less than £100.
