HOW TO BID AT A TIMED AUCTION

1)     Each lot can be bid on for the time period displayed. During this period, you can place your bid at any time. Simply enter the highest amount you are prepared to pay as your ‘maximum bid’. Your bids need to be in accordance with their timed auction increments, which are set by i-bidder, so the computer may not take your bid if it is not the correct amount.  When bidding, the system notifies you of the next required minimum bid increment.

2)     When you place a ‘maximum bid’, i-bidder.com bids on your behalf as much as necessary to ensure sure that you meet the reserve price or that you remain in the lead, up to your ‘maximum bid’. Your ‘current bid’ is clearly displayed when you log in and view the lot for which you’ve left a ‘maximum bid’. In many cases your ‘current bid’ is lower than the ‘maximum bid’ you entered. If another bidder places a bid that is higher than your ‘maximum bid’, you will be notified by email. Your ‘maximum bid’ remains confidential until it is exceeded by another bidder. If you have the leading bid and you have met or exceeded the reserve price when the defined time period ends, you will have won the bidding for this lot.

3)     If a bid is placed in the last ten minutes of the defined time period, the time period will be extended by ten minutes. This is the ’10 minute auto bid extension’ and is to prevent 'sniping'.

4)     There are two ways to monitor whether your bids are in the lead in a timed auction: Log into i-bidder.com and then:

a)     Either go to the ‘’My Bidder’ section of the site. You will find a summary of the bids you’ve left for auctions currently in progress in 'Current bids'. Click on the 'Leading' link and you will be presented with all the lots for which your bid is currently in the lead. Click on the 'Outbid' link and you will be presented with all the lots for which your bid is not leading.

b)      Or go to the timed auction in which you’re bidding. Find the lot on which you're bidding and click through to the lot description page. The details of your current bid, maximum bid and whether you’re in the lead are indicated on the right hand side of the screen.

5)     By placing a bid on any item, the bidder is deemed to have inspected the goods prior to placing the bid and has agreed to our terms and conditions.  Each lot is bought and sold as seen, as they lie; no warranty is offered or implied.

6)      When a timed auction has finished, you will find details of lots you’ve won in the ‘My past bids’ section of ‘My Bidder ’. Please note that you are not guaranteed to have won the lots listed in ‘My Bidder ’. The Auctioneer's records are the definitive version of the auction.

7)     If you are successful, the Auctioneer will email a winner’s notification with full payment details to you at the end of the sale,

8)     When bidding do not forget to `Refresh` your screen regularly (press F5 button) to ensure you are aware of current bids, (your screen can appear to be changing in real time but may not be accurate unless you ‘Refresh’).

The bidder must decide whether the description is correct and bid on what they have viewed and not on what has been described. All lots can be viewed on our viewing days.
  • Timed Auction sales are not classified as consumer sales (sale of goods act 1893 section 55 (7) therefore misrepresentation acts of law do not apply).
  • The auctioneer will regulate the bidding and decide in what increments the bid will be raised. The purchaser will be determined only when the hammer has gone down or the auctioneer says sold. Once the hammer has gone down the purchaser is in a legal binding contract to purchase the said lot for the amount bid plus the Auctioneers charges. Please note that your acceptance of these terms gives OPS Auctions  your permission to complete all invoices on the card that you have provided for your deposit, unless alternative payment arrangements have been made with OPS Auctions. Please note that the item becomes the buyer’s responsibility from that time on.

Should they fail to remove the goods within the time given they will be liable to forfeiture of any and all money paid (deposit) or storage and attendance fees.
  • Any goods not removed within the time scale given will be liable to re sale and any short fall will be charged to the original purchaser.
  • All successful bids will be liable to a buyer’s premium (amount will be in the catalogue or stated) and VAT will be added to the total at the standard rate at that time.
  • A deposit is required either at the time of obtaining your bidding card or registering on-line, any person not paying the required deposit will be excluded from making any further bids and the lot will be put back up for sale.
  • No goods can be removed or invoices paid while the auction is in progress and goods can only be removed when a paid invoice is handed to a member of staff.
  • No purchaser can remove goods without a member of staff being present and any disputes regarding what was purchased will be determined by the auctioneer. Their decision is final and cannot be challenged or disputed.
  • The purchaser must have all electrical or gas items checked by a registered engineer before connecting or using the goods.
  • All lots will be auctioned in the numerical order laid down in the catalogue. Save for vehicles and / or other items which will be clearly defined.
  • If goods are sold by tender then the bidder has to comply with all the above terms and conditions as it would relate to the sale being completed as a tender. The tender must be completed and returned within the time scale stated in the catalogue and the appropriate deposit must accompany the tender form.
  • Should there be identical highest bidders the auctioneer reserves the right to ring both or all parties and offer them the opportunity to increase their bid.
  • Should the tender allow a bid in its entirety (i.e. all goods) the auctioneers reserves the right to accept that bid over all the individual bids should he feel that doing so would reduce costs which in turn would result in more money for the client.
  • Any person not completing the purchase after either bidding or tendering for the goods lotted, they will lose the deposit given and the goods will either be re advertised and sold or offered to the under bidder, should the auctioneer incur costs or the client receive less than the original amount tendered, the original bidder will be liable for shortfalls.
  • HEALTH AND SAFETY AT WORK ACT 1974: It is expressly brought to the Bidder’s attention that, at the time of sale, any item of plant, machinery or equipment contained in the lot(s) may not necessarily comply with the Health and Safety at Work etc. Act 1974, Environmental Protection Act 1990, or any other Acts or Regulations there-under governing the use of the plant, machinery or equipment in a working environment. Successful Bidders for any such plant, machinery or equipment are hereby required to ensure that the use of any such plant and equipment at a place of work within the United Kingdom does not contravene such relevant Act or Regulation there-under applicable thereto. The goods are not sold as articles for use at work; they are sold on the understanding that the Vendor does not represent them as being in a condition which makes them suitable for use at work. The purchaser is reminded that if, nevertheless, any of the goods or articles purchased are intended by him to be supplied in due course for use at work, the Purchaser should, before so supplying them for such use, take such steps as are necessary to ensure, so far as is reasonably practicable, that such goods or articles will be safe and without risks to health when properly used and should carry out or arrange for the carrying out of such testing and examination as may be necessary to enable him to carry out the obligations imposed by the Health and Safety at Work Act 1974.
  • EXPORT OF GOODS: The sale of goods as described in the catalogue shall not imply that Department of Industry licenses for export of the goods in their present or modified condition will be granted to a Purchaser. The pursuit of any such licenses is entirely a matter for the Purchaser. Purchasers intending to export their purchases are required to advise the Accounts Department at MST Auctioneers Ltd and to pay a deposit amounting to the value of the VAT.  This will be refunded in full as per the following:
  • Export of goods within the EEC – The sale can be zero rated for VAT on production of a current valid letterhead from the company purchasing the goods with a valid VAT registration number from the country concerned – this must be confirmed on https://ec.europa.eu/taxation_customs/vies/vieshome.do   In order to comply with HM Revenue & Customs we will take a deposit equal to the amount of VAT concerned. • Export of Goods outside the EEC – All goods will be subject to VAT at the current standard rate. In order to qualify for a refund of the VAT and for the sale to be zero rated the goods must be exported within 3 months from the time of purchase and valid evidence of export ie: a Bill of Landing, is received by the Auctioneers within one month of the date of export.
  • AUCTIONEERS NOTES: We have the right to revise and amend these terms and conditions from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system's capabilities.  Each lot is bought and sold as seen; no warranty is offered or implied.   Viewing before bidding is strongly recommended.  The description of the lot by the auctioneer in the language of the auction is the governing description.
