  • No guarantee or warranty is given, implied, presumed or assumed with any item in any lot.
  • No member of staff or anybody in the employment of the auctioneers has the authority to give a warranty or to make any other representation in relation to any lot. Implied conditions & warranties are excluded.
  • The potential bidder is welcome to examine the goods prior to the sale for confirmation & assurances as to the condition of each item. The bidder must decide whether they want to bid on the item as seen in our auction room not what has been described.
  • Viewing will only be available at the subscribed times; the auction rooms are closed otherwise. Viewing times are Friday 11am - 5pm unless specified.

  • VAT is at the standard rate of 20%
  • Buyers Premium is 15% + VAT.
  • Internet Fees – A 3% surcharge is added to the hammer price on all items purchased through I-Bidder.

  • Please ensure you have checked your Items and they are correct. Unfortunately we cant offer refunds once the goods have left the site unless for good reason.
  • Neither the Vendor nor the Auctioneers, their staff or agents are responsible for any errors of description or for the authenticity of any lot.
  • Catalogue descriptions or statements made at the time of sale are not guaranteed as being correct; they merely describe the item seen and however its usually ascertained from the packaging and only used for identification purposes. From time to time the catalogue may have errors in; it is your responsibility to be sure of what you’re purchasing.
  • All lots are sold in accordance with the “Auctions and Bidding agreements Act” which places responsibility upon the purchaser and all risks to the purchaser.
  • Live & Online Auction sales aren’t classified as consumer sales (sale of goods act 1893 section 55 (7)
  • The auctioneer will decide the bidding increments.
  • Online auctions; the winning bidder will be determined at the end of the allotted time for each auction.
  • Once the timed auction has finished and the winning bidder has been determined, the purchaser is in a legal binding contract to purchase the lot for the amount bid plus the Auctioneers charges.
  • Please note: Your acceptance of these terms & conditions gives consent to Surplus Stock Auctions to complete all invoices on the information that you have provided from your deposit, unless alternative payment arrangements have been made with Surplus Stock Auctions.
  • Please be aware that the winning lot becomes the purchaser’s responsibility once payment has been made. 
  • The purchaser is also responsible to arrange for all the goods purchased to be removed within the time scale given and in the correct manner. Collection days and times are announced for each particular Auction. Failure to remove the goods within the time scale given will unfortunately be liable to forfeiture including any and all money paid (deposit) or storage and attendance fees.
  • In the failure to remove the goods within the time scale given, the item will be re-sold at a later date and any short fall will be the liability of the original purchaser.
  • Any machinery purchased through our auctions must comply with the Health & Safety at work act 1974.
  • It is the buyer’s responsibility to ensure that only a qualified engineer is used to remove machinery they have bought.
  • Any vehicle purchased through our auction can only be collected by a person who holds a correct licence. If any are removed after purchase without the correct license, we will not be held responsible for any liabilities that occur.
  • It is the buyer’s responsibility to have all electrical or gas items checked by a registered engineer before connecting or using the goods in the way that they were designed.
  • Winning bids are liable to a buyer’s premium as stated in the catalogue and VAT will be added to the total at the present standard rate.
  • A deposit is required when registering on-line to bid for lots.
  • Invoices cannot be paid nor can goods be removed from the premises whilst the auction is in progress.
  • Only a member of staff can authorise the removal goods from the premises with a valid paid invoice; any disputes arising regarding purchased lots will be determined with discretion by the auctioneer. The auctioneer’s decision is final without challenge or dispute.
  • All the lots will be auctioned in the numerical order as printed in the catalogue unless specified.
  • The above terms & conditions are in place as the goods are sold by forced sale and also can be completed as a tender and must comply with guidelines set out for such sales. The tender must be completed & returned with the appropriate deposit in the time scale stated.
  • Should the tender allow a bid for all the lots/goods in the auction, the auctioneer reserves the right to accept the bid for the client and to null & void all other bids if by doing so would result in more money for the client.
  • Any uncompleted purchases after the time scale given will be paid for by the winning bidder losing their deposit. The goods will then either be re-advertised and re-sold or offered to the under bidder. Any costs incurred will be paid for by the previous winning bidder including shortfalls.
