Business-to-Business Auction Terms & Conditions
Governing Law: England & Wales — Effective Immediately

1. Definitions

1.1 “Auction” means a public or private sale conducted by the Auctioneer where Lots are sold to the highest Bidder.
1.2 “Auctioneer” means Auction247 Ltd (t/a “Auction247”), including employees, agents, representatives, or any delegated party acting on its behalf.
1.3 “Bid” means a binding offer placed by a Bidder to purchase a Lot.
1.4 “Bidder” means any party placing a Bid.
1.5 “Buyer” means the Bidder who wins a Lot when the Auctioneer accepts the highest Bid.
1.6 “Buyer’s Premium” means 26% plus VAT payable by the Buyer on every Lot.
1.7 “Goods” / “Lot(s)” means any items offered for sale.
1.8 “Seller” means the legal owner of the Goods who instructs the Auctioneer to sell them.
1.9 “VAT” means Value Added Tax at the prevailing UK rate.
1.10 “Overseas Purchaser” means a Buyer based outside the United Kingdom.

2. B2B Status and Contract Formation

2.1 All Auctions are strictly Business-to-Business (B2B) transactions.
2.2 No consumer legislation applies, including the Consumer Rights Act, Consumer Contracts Regulations, Distance Selling rules or cooling-off periods.
2.3 By bidding, the Bidder irrevocably accepts these Terms in their entirety.

3. Auctioneer’s Authority

3.1 The Auctioneer acts solely as agent for the Seller, not as principal.
3.2 The Auctioneer may refuse bids, withdraw Lots, reopen bidding, divide Lots, combine Lots or settle disputes at its absolute discretion.
3.3 No warranty or representation is given or implied by the Auctioneer regarding description, condition, safety, suitability, or fitness of any Lot.

4. Registration, Bidding and Buyer Obligations

4.1 Bidders must register with accurate information and secure their account access.
4.2 All Bids are final, binding and non-retractable.
4.3 The winning Buyer must complete the transaction without exception.
4.4 Lack of viewing or lack of enquiry is not grounds for cancellation.

5. Buyer’s Premium and Charges

5.1 A 26% Buyer’s Premium + VAT applies to all Lots.
5.2 Additional storage, administrative and recovery charges may apply.

6. Payment Terms (Bank Transfer Rule)

6.1 All Lot payments must be made by bank transfer only. No credit or debit card payments are permitted for Lots under any circumstances.
6.2 Credit or debit card payments are accepted only for postage and packaging (shipping) charges, where applicable.
6.3 Lot invoices must be paid within 2 days of invoice. Time is of the essence.
6.4 Goods will not be released until full cleared payment is received by bank transfer for the Lot(s).
6.5 Failure to pay in full shall place the Buyer in default.

7. Collection and Restricted Access

7.1 Goods must be collected within 2 days of the Auction end unless otherwise stated.
7.2 Once a Lot leaves the premises, it is deemed accepted in full, with no right of return or complaint.
7.3 The Buyer is responsible for labour, lifting equipment, transport and insurance during collection.
7.4 The Auctioneer accepts no liability for accidents, injury or damage during collection.
7.5 Restricted Collections (Health & Safety & Site Access)

Certain Lots may not be available for physical collection due to Health & Safety regulations, insurance rules, secure-site access, or third-party policies. Where collection is prohibited, no in-person access will be granted, and the Buyer must use a delivery option where available. These restrictions are mandated by site operators and safety legislation, not by Auction247 Ltd. The Buyer must check collection availability before bidding. No cancellation, refund, refusal to pay, or withdrawal from a purchase will be accepted on these grounds.
7.6 Delivery Requirement Where Collection Is Prohibited
Where collection is not permitted, the Buyer must pay all delivery charges in full. Failure or refusal to pay delivery costs shall be treated as non-payment and default, with full penalties under these Terms.

8. Delivery, Courier Liability & Postage

8.1 Auction247 does not arrange, manage, supervise, track, organise or chase any courier or delivery on behalf of the Buyer.
8.2 Minimum postage,per  packaging and handling fee is £14.99 per consignment, non-negotiable.
8.3 Risk transfers to the Buyer at the moment of dispatch.
8.4 Auction247 accepts zero liability for loss, delay, damage, theft or failed delivery in transit.
8.5 All courier claims must be pursued directly with the courier by the Buyer.
8.6 Courier Insurance Waiver: If the Buyer declines insured shipping or chooses a basic/uninsured service, they accept full transit risk and waive all claims.

9. Condition of Goods

9.1 All Lots are sold as seen, with all faults, defects, incompleteness, and imperfections.
9.2 No warranties, guarantees, returns or fitness-for-purpose conditions apply.
9.3 Viewing is encouraged. Failure to view is not a defence, dispute or cancellation right.

10. Default, Storage, Resale & Recovery

10.1 Storage is charged at £20 per Lot per day, or £50 per Lot per day for vehicles / heavy items.
10.2 After 28 days, uncollected Lots may be resold, retained or disposed of with no compensation to the Buyer.
10.3 All losses, storage, transport and resale shortfalls are recoverable from the Buyer.
10.4 Additional legal and administrative fees apply in default cases.

11. Chargebacks

11.1 Chargebacks are strictly prohibited.
11.2 Any chargeback will result in:
(a) £250 + VAT administrative fee
(b) storage charges
(c) legal recovery
(d) civil action if necessary

12. Liability and Indemnity

12.1 Auction247 accepts no liability whatsoever for loss, damage, delay, theft, negligence, incident, or consequential loss.
12.2 The Buyer indemnifies Auction247 against all claims arising from their acts, omissions, collection or transport.

13. Data and Recording

13.1 Communications may be recorded.
13.2 Data is processed per the Auctioneer’s Privacy Policy.

14. Jurisdiction

14.1 These Terms are governed by English law.
14.2 Jurisdiction is exclusively England & Wales.

15. Entire Agreement

15.1 These Terms form the full binding agreement between Buyer and Auctioneer.
