AUCTION247 LTD TERMS AND CONDITIONS

1. BASIS OF SALE

1.1 All goods are sold by auction.
1.2 All sales are strictly business-to-business (B2B) and for resale purposes unless expressly stated otherwise.
1.3 By registering, bidding, or purchasing, the buyer confirms they are acting in the course of business.
1.4 These Terms form the entire agreement between Auction247 Ltd and the buyer.
1.5 No third party (including auction platforms) has authority to alter or override these Terms.

2. LEGAL STATUS OF BIDS

2.1 All bids are legally binding offers.
2.2 Winning bids form a binding contract upon auction close.
2.3 Bids cannot be withdrawn or cancelled.
2.4 Failure to honour a bid constitutes breach of contract.
2.5 Auction247 Ltd may pursue recovery through legal action and enforcement.

3. PAYMENT TERMS

3.1 Full payment is due within 24 hours of invoice.
3.2 Payment must be made by bank transfer unless otherwise agreed.
3.3 A 26% Buyer’s Premium + VAT applies to all lots.
3.4 Late or non-payment will trigger enforcement, storage charges, and recovery action.

4. DEPOSITS & RISK CONTROL

4.1 Auction247 Ltd may require a £100 deposit from bidders deemed high risk.
4.2 Deposits are non-refundable where terms are breached or bids are not honoured.
4.3 Deposits may be retained against losses, damages, or unpaid balances.

5. STORAGE & DEFAULT

5.1 Storage is charged at £50 + VAT per lot per day after the payment deadline or failure to arrange delivery.
5.2 Auction247 Ltd reserves the right to re-auction, retain, or dispose of goods.
5.3 Buyers remain liable for all losses, costs, and shortfalls.

6. POSTAGE, HANDLING & DELIVERY

6.1 A minimum one-off handling charge of £20 + VAT per invoice applies.

6.2 All delivery, postage, and handling charges are variable and non-fixed, depending on:

• Courier provider
• Service level (standard, tracked, signed, express, insured)
• Size, weight, and handling requirements
• Delivery location and access

6.3 Any delivery pricing is indicative only and not contractually binding.

6.4 Auction247 Ltd reserves the right to:

• Select courier and service level
• Consolidate or split shipments
• Adjust delivery method as required

6.5 Delivery is carried out by third-party logistics providers.
6.6 Auction247 Ltd accepts no liability for delays, loss, damage, or failed delivery.

6.7 Risk passes to the buyer upon dispatch.

6.8 Buyers must ensure:

• Correct delivery details
• Suitable access
• Availability to receive goods

6.9 No collection service is permitted due to Health & Safety regulations.

7. PALLET & BULK DELIVERY

7.1 Pallet and bulk delivery charges are variable and subject to change.
7.2 Charges depend on size, weight, location, access, and courier pricing.
7.3 Additional costs may include labour, wrapping, strapping, and handling.
7.4 Failed delivery results in redelivery charges and storage fees.
7.5 Buyers accept all pallet costs as final and non-refundable.

8. CONDITION OF GOODS

8.1 All goods are sold as-is, where-is, with all faults.
8.2 Items may be untested, incomplete, damaged, or used.
8.3 No guarantees are given regarding condition or functionality.

9. INSPECTION & ACCEPTANCE

9.1 Buyers must inspect goods prior to bidding where possible.
9.2 Any claim must be made within 48 hours of delivery.
9.3 Claims outside this period are rejected.
9.4 Opening, using, or tampering with goods constitutes full acceptance.

10. FINALITY OF SALE

10.1 All sales are final.
10.2 No refunds, returns, or exchanges.
10.3 Payment confirms full acceptance of goods and these Terms.

11. CHARGEBACKS, DISPUTES & ENFORCEMENT

11.1 Buyers agree not to initiate chargebacks or payment disputes.
11.2 Any dispute does not cancel or suspend the debt.
11.3 Buyers remain liable for:

• Full invoice value
• Chargeback fees
• Administrative costs
• Legal and recovery costs

11.4 Auction247 Ltd may pursue recovery through:

• County Court Judgment (CCJ)
• High Court enforcement
• Debt recovery agencies

11.5 Recovery may be pursued through any lawful civil action.

11A. DIRECTORS & EMPLOYEES LIABILITY

11A.1 All contracts are with Auction247 Ltd only.
11A.2 No director, employee, or representative has personal liability.
11A.3 Buyers agree not to pursue individuals personally.

11D. PERSONAL ADDRESS & CONTACT RESTRICTIONS

11D.1 All communication must be through official business channels.
11D.2 No attendance at private or residential addresses is permitted.
11D.3 Breach may result in legal action and recovery of costs.

12. LIABILITY LIMITATION

12.1 Auction247 Ltd is not liable for incorrect, missing, or substituted items.
12.2 All goods are sold under caveat emptor.

13. SPECIAL CATEGORY GOODS

13.1 Watches: no guarantee of authenticity, performance, or warranty.
13.2 Mystery or clearance lots: contents unknown, no guarantees.
13.3 Aviation or themed stock: indicative values only, not guaranteed.

14. COST RECOVERY

14.1 Buyers are liable for all costs arising from breach.
14.2 Includes legal, administrative, and recovery costs.

14.3 Director and staff time:

• £250 + VAT per day
• £75 + VAT per hour (minimum 1 hour)

14.4 All costs are recoverable and may be added to the debt.

14A. INTEREST ON LATE PAYMENTS

14A.1 Interest applies at 8% above Bank of England base rate.
14A.2 Calculated daily until payment is made.

15. FRAUD & ABUSE

15.1 Fraud, abuse, or misuse may result in suspension and legal action.

16. TITLE & OWNERSHIP

16.1 Ownership does not pass until full payment is received.

17. NON-PAYMENT & RE-AUCTION

17.1 Goods may be resold if payment is not made.
17.2 Buyer remains liable for any shortfall and costs.

18. NO RELIANCE

18.1 Buyers confirm no reliance on external statements.
18.2 All descriptions and values are guidance only.

19. FORCE MAJEURE

19.1 No liability for events beyond reasonable control.

20. PLATFORM NON-LIABILITY

20.1 Auction platforms act as intermediaries only.
20.2 Auction247 Ltd is the sole contracting party.

21. FINAL AUTHORITY

21.1 All Auction247 Ltd decisions are final and binding.

22. VARIATION OF TERMS

22.1 Terms may be updated at any time.
22.2 The version at time of bidding applies.

23. SEVERABILITY

23.1 If any clause is unenforceable, the remainder remains valid.

24. GOVERNING LAW

24.1 These Terms are governed by the laws of England and Wales.

24A. JURISDICTION & VENUE (SOUTHEND-ON-SEA)

24A.1 Contracts are deemed made in Southend-on-Sea.
24A.2 Southend-on-Sea is the preferred venue for proceedings.
24A.3 Buyers agree not to object to this venue where legally permissible.
24A.4 Auction247 Ltd may issue proceedings in any court if required.

24B. SERVICE OF DOCUMENTS

24B.1 Legal documents are served at the registered office (London).
24B.2 No service to personal or residential addresses is permitted.

25. EVIDENCE

25.1 Auction247 Ltd may rely on:

• Call recordings
• Bid history
• Platform data
• IP records

as evidence in any dispute.

26. BUYER ACCEPTANCE

26.1 By bidding, buyers confirm full acceptance of all Terms.
