37.4 Abandoned goods may be resold, disposed of, returned to vendor, stored or otherwise dealt with at Auction247 Ltd’s discretion.
37.5 The Buyer remains liable for any shortfall, fees, storage charges, delivery charges, administration costs and recovery costs.
38.1 Storage, holding and delay charges may apply where goods cannot be dispatched, delivered, released, cleared, processed or completed due to Buyer default, non-payment, late payment, refusal of delivery, failed delivery, incorrect delivery details, access issues, failure to provide information, failure to pay delivery charges, failure to cooperate with courier arrangements, chargeback, dispute or any other delay caused by the Buyer.
38.2 Storage and holding charges may be charged at up to £50 per Lot, item, pallet, consignment or invoice, per day, depending on the size, value, location, handling requirements and storage burden of the goods.
38.3 Storage charges may begin from the date the Buyer becomes in default, the date delivery is refused or failed, the date goods are ready for dispatch but cannot be released, the date a chargeback or dispute is raised, or the date notified by Auction247 Ltd.
38.4 Storage charges are a reasonable commercial charge to cover warehouse space, handling, administration, insurance risk, vendor charges, courier delay, staff time and disruption caused by the Buyer’s failure to complete the transaction properly.
38.5 Storage charges may continue until all outstanding sums are paid, delivery is completed, the goods are resold, returned to vendor, disposed of, abandoned or otherwise resolved.
38.6 Storage charges may be added to the Buyer’s outstanding balance and pursued as a debt.
38.7 Payment of storage charges does not transfer risk back to Auction247 Ltd and does not prevent Auction247 Ltd from exercising any other rights under these terms.
38.8 If storage charges remain unpaid, Auction247 Ltd may cancel the sale, retain sums already paid, resell the goods, dispose of the goods, treat the goods as abandoned, suspend the Buyer’s account, ban the Buyer and/or recover all outstanding losses and costs.
39.1 Where the Buyer fails to pay any invoice, delivery charge, storage charge, recovery cost or other sum due to Auction247 Ltd, Auction247 Ltd may pass the account to an external debt collection company, solicitor, recovery agent, tracing agent, enforcement agent, platform recovery team or other professional adviser.
39.2 The Buyer agrees that Auction247 Ltd may share the Buyer’s name, business name, address, telephone number, email address, invoice details, bidding records, payment records, delivery records, dispute records and any other relevant account information with such third parties for the purpose of debt recovery, dispute handling, legal action, enforcement, fraud prevention or account administration.

39.4 Auction247 Ltd may add such reasonable recovery costs to the Buyer’s outstanding balance and pursue them as a contractual debt.
39.5 Passing an account to an external collection company does not prevent Auction247 Ltd from suspending the Buyer’s account, banning the Buyer, cancelling the sale, relisting the goods, treating goods as abandoned, retaining sums already paid, claiming storage charges or taking court action.
39.6 This clause applies to non-payment, late payment, failed payment, refused delivery, failed delivery caused by the Buyer, unpaid delivery charges, unjustified chargebacks, unpaid storage charges, breach of auction terms or any other Buyer default.
40.1 The Buyer shall be liable for all reasonable costs, losses, charges and expenses incurred by Auction247 Ltd in enforcing these terms, recovering unpaid sums, defending chargebacks, dealing with Buyer default, dealing with non-payment, handling disputes, handling complaints, attending court, preparing legal evidence, relisting goods, storing goods, arranging courier returns, or otherwise protecting Auction247 Ltd’s position.
40.2 Recoverable costs may include, but are not limited to:

(n) director time spent on investigation, administration, evidence preparation, complaint handling, dispute handling, chargeback defence, debt recovery, court preparation and court attendance.
40.3 Staff time and director time may be charged at a reasonable commercial hourly or daily rate, depending on the work required, the time spent, the seriousness of the matter and the disruption caused to Auction247 Ltd’s business.
40.4 Director attendance at court, mediation, hearings, case-management appointments, enforcement hearings or any other legal process may be charged as a reasonable commercial cost, together with travel, parking, accommodation, subsistence, preparation time and loss of business time.
40.5 Director and staff time may also be charged at a reasonable commercial hourly or daily rate where time is spent dealing with non-payment, disputes, complaints, chargebacks, debt recovery, legal preparation, court attendance, courier issues, refused delivery, failed delivery or breach of auction terms.
40.6 Where Auction247 Ltd uses solicitors, debt recovery agents, enforcement agents, process servers, tracing agents, platform representatives, accountants or other professional advisers, the Buyer shall be liable for all reasonable fees and expenses incurred to the fullest extent permitted by law.
40.7 Where a Buyer raises an unjustified chargeback, payment dispute, platform dispute or false claim, Auction247 Ltd may charge a reasonable administration and evidence-preparation fee, together with any bank fees, platform fees, legal fees, staff time, director time and storage charges incurred.
40.8 All such costs may be added to the Buyer’s outstanding balance and pursued as a contractual debt.

36.1 Buyers agree not to initiate unjustified chargebacks, payment reversals, bank disputes or platform disputes.
36.2 Before raising any chargeback or dispute, the Buyer must first follow the formal claims procedure and provide evidence to Auction247 Ltd.
36.3 Where a chargeback is raised without proper grounds, Auction247 Ltd may recover the chargeback amount, bank fees, administration costs, platform costs, legal costs, recovery costs, staff time and director time.
36.4 Auction247 Ltd may use invoices, bid records, platform records, call recordings, email records, courier records, photographs, delivery records and these terms as evidence in any chargeback defence.

41.3 Nothing in these terms shall exclude or restrict liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any liability which cannot lawfully be excluded.
42.1 Auction247 Ltd will use reasonable endeavours to keep website, catalogue, listing and platform information accurate, but no guarantee is given that information will be complete, current, uninterrupted, error-free or free from technical faults.
