Before pick up the invoice must be paid. Collection can take place d. 26/10-2015, and no later than 30/10-2015. Receipt of payment and invoice must be presented at pick up whether it's internal or external transport.
SALE CLOSES: From 13.00pm TUESDAY 22TH October at 3 min intervals between lots.
Please note that in the event of a bid being received within 10 minutes of the scheduled closing time, the bidding period on that lot will automatically extend by a further 10 minutes. Eftersyn: Eftersyn kan ske på oplyste adresser for eftersyn dog kun på de oplyste datoer.
1. Alle varer sælges som beset uden nogen form for reklamationsret. Reklamationer tages ikke til følge. Der kan ikke gøres ansvar af nogen art gældende over for hverken indsætter, auktionsholder, rekvirent eller skifteret. Dette omfatter ansvar for funktionsduelighed, stand, lovlighed, angivelser af mål, vægt, dimensioner, alder og beskrivelse. Danish Auction A/S foretager ikke funktionsduelighedsprøver eller anden kontrol af varer.
2. Til budsum lægges auktionssalær: 15 % af budsum (dog min. 100,- kr. pr. enhed) + 2 % internet omkostning + 25 % moms ved salg til ALLE kunder.

Eksempel: ved bud på 1.000 kr. + 15% salær = 1.150 kr. + 2 % internet omkostning = DKK 1.173,- + 25% moms = 1.466,25 kr.

Visse køretøjer er undtaget for moms på budsum, men der skal betales moms af salær.
3. Skærpede regler for opkrævning af moms:
Der kommer skærpede krav til dokumentation for, at sælger er berettiget til momsfritagelse i forbindelse med afhentningskøb, hvor en udenlandsk køber afhenter varer hos en dansk sælger.
Ved salg til et andet EU-land/øvrige udland skal sælger (Danish Auction A/S) opkræve moms. Momsen kan refunderes ved dokumentation for, at varen er ført ud af landet. Hvis køber selv afhenter varerne, skal køber give en erklæring til sælger (Danish Auction A/S) om:

* at varen er sendt eller transporteret fra Danmark

* varens bestemmelsessted

* transportmiddel og registreringsnummer på transportmiddel

* at varen er modtaget på leveringsadressen.
Stramningerne gælder også, hvor en tredjemand forestår transporten fra sælger (Danish Auction A/S) til køber. Sidste punkt betyder, at erklæringen først kan afgives, når varen er modtaget på bestemmelsesstedet.
Danish Auction A/S opkræver altid moms i forbindelse med salg. Når køber kan dokumentere, at betingelserne for momsfrit salg er opfyldt, kan Danish Auction A/S udstede kreditnota, og ny faktura uden moms. Danish Auction A/S vil så sende den opkrævede moms retur til køber
4. Varerne skal betales med BANKOVERFØRSEL. Udenlandske kunder kan benytte bankoverførsel via IBAN/SWIFT umiddelbart efter auktionen. ( pengene skal overføres som expres)
5. Længere tidsfrist for vareudlevering kan efter forudgående aftale tillades for varer, som skal afmonteres. Såfremt varen ikke er afhentet i udleveringstidsrummet, fjernes varerne for købers regning. Danish Auction A/S kan vælge at sælge uafhentede varer under hånden eller ved frivillig auktion. Salget sker i begge tilfælde for købers regning, så denne er pligtig at erstatte det deraf flydende tab uden at have ret til det mulige overskud.
6. I de tilfælde hvor der er reservationspris noteret på katalognumrene, gælder “byd for at købe også selvom reservationsprisen ikke er opnået. Hvis det er tilfældet, bliver byder kontaktet, hvis bud summen skal træde i kraft.
Enhver handel på online auktioner skal i øvrigt følge auktionsbetingelserne.
7. Efter endt online auktion står varen for købers regning og risiko. Køber skal selv sørge for afhentning, afmontering/nedtagning efter Danish Auctions anvisning. Beskadigelse i forbindelse hermed er alene købers risiko. Ved evt. skader på bygninger skal disse reetableres. Ved afmontering af el, gas, vand, varme og afløb indestår køber for at dette sker efter gældende regler og lovgivning. Salget sker i øvrigt uden ansvar for Danish Auction A/S
8. Køber har det fulde ansvar for, at købt materiel opfylder lovmæssige krav forinden ibrugtagning. Køber har endvidere det fulde ansvar for at indhente tilladelse til brug af diverse software/patenter m.m. af de respektive rettighedshavere.
9. For at købe på Danish-auction.com skal køber have registreret CVR nummer.
10. Køber skal ved afhentning forevise kvitteret faktura. Hvor køber lader vognmand m.v. afhente købte effekter, skal disse medbringe originaleksemplar, fotokopi eller fax-kopi af kvitteret faktura eller kvittering af bankoverførsel.
 
11. Al færdsel på auktionsområdet sker på eget ansvar.
 

 

Danish Auction A/S Terms and conditions

ITEM LOCATIONS: As stated in the description of the lot.
VIEWING: Viewing may take place on the allocated day only. Access to the lot storage sites for viewing will be denied at all other times .
1.ALL ITEMS “SOLD AS IS” with no warranty given or implied
All goods is sold ‘as is’ without any form of right to claim. Claims will not be admitted. No damages of any kind can be claimed from neither the seller, the auctioneer, the bid caller, the applicant, nor the bankruptcy court. This includes liability for ability to function, condition, lawfulness, indications of measurements, weight,dimensions, age, and description. Danish Auction A/S does not perform any sort of function test or other kind of inspection of the lots prior to the auction.
2. The buyers premium is added to the bid: 15% of the bid sum (with a minimum of DKK 50,- per unit) + 2 % internet surcharge + 25% VAT for sales to customers residing in Denmark. Example: Bid: DKK 1000,-: 15% auction fee = 1150 DK + 2% internet surcharge= DKK 1173,- excl. VAT (25%). Minimum fee is DKK 100,-. Certain vehicles are exempt from VAT on the bid sum, but is payable for the auction fee and internet surcharge.
EXPORT BUYER REGISTRATION: Any customers that are buying goods with the intention of exporting them from Denmark & wish to reclaim the VAT in relation to these goods MUST confirm this with Danish Auction A/S before bidding on any item within the auction. Copies of Passports & company registration documentation will be required. Rules & conditions apply to all VAT refund requests. Please contact Danish Auction A/S for clarification & further details.
OVERSEAS BUYER GUIDELINES:
Overseas Buyers should ensure that the country to which the items are destined:
• holds no import restrictions on the goods to be purchased;
• has no import licence restrictions or a restriction on currency allocation;
• has no prolonged inspection procedure which might cause excess delay or refusal in allowing your goods to be imported.
Overseas Buyers will receive a fully descriptive invoice in order that they may arrange payment as soon as possible with the Company`s bank.
Overseas Buyers should employ a suitable freight forwarding organisation. Please note that many of the machinery removal companies in Denmark are not necessarily freight forwarders. 
The Company makes no representation and accepts no liability whatsoever to any Buyer in respect of the issuance or validity of any exportation or importation permits or the existence and exercise of exportation or importation regulations or any compulsory purchasing regimes.
Stricter regulations are coming for documentation for a seller’s entitlement to a value added tax exemption in connection with cash-and-carry transactions where a foreign purchaser picks up products from a Danish seller.
For sales transactions to another EU country, the seller must collect value added tax, unless the seller is able to document that the product is being transported to another EU country and that the purchaser’s value added tax number has been verified.

The purchaser picks up the product:

If the purchaser picks up the product themselves, the purchaser must declare to the seller:

– that the product is being sent or transported from Denmark,

– the product’s destination,

– the means of transportation and the registration number of the means of transportation, and

– that the product has been received at the delivery address.

The tightening of the regulations also applies when a third party handles the transport from the seller to the purchaser.

The last sentence means that the declaration cannot be made until the product has been received at the destination.

Danish Auction A/S always collects value added tax in sales transactions.
When the purchaser is able to document that the terms for a value added tax exempt sales transaction have been met, Danish Auction A/S can issue a credit note and a new invoice without value added tax – and at the same time return the value added tax that was collected to the purchaser.
4. The goods is paid by IBAN/Swift – transferred directly to our bankaccount immediately after the auction has closed. Eurocard and MasterCard are not accepted. The merchandise is handed over to the buyer only when a cheque or Dankort is cashed. After prior agreement, payment by IBAN/SWIFT can be transferred directly to our account immediately after the auction.
5. Delivery of goods: The time for delivery of goods is stated for each auction on the homepage www.danish-auction.com. Items collected must be paid for before collection and the collection must take place within the periods stated, according to the terms of the auction. A longer period before delivery may be accepted by prior agreement if items have to be dismounted. Goods must be removed within the delivery period. If the goods is not pick uped during the delivery period, it is removed and the buyer pays the transport.
6. Danish Auction A/S may choose to sell unclaimed goods confidentially or by a private auction. In both cases the sale is made on the buyer’s account, and the buyer is therefore liable to compensate for the resultant loss without being entitled to any possible profit. Participation in the bidding requires previous registration as a buyer. An invoice is made out to the winning bidder with the data stated by the buyer in connection with the registration. If a buyer wishes to modify these data after a successful bid, an administration fee of DDK 1000 + VAT is charged. Lots where there is a reserve, the "bid to buy counts, even if reserve is not reached. If that is the case it is up to the seller and bidders will be contacted by Danish Auction.
9. After a sale the goods remains for the buyer’s account and risk. It is the buyer’s responsibility to arrange for the merchandise to be dismantled and collected. Any damage in this connection is entirely the buyer’s risk. If damage to buildings should occur, they must be repaired. In connection with disconnection of power, gas, water and drains the buyer is responsible for compliance with current rules and legislation. Also in other aspects the sale takes place without any responsibility for Danish Auction A/S, the seller or the bid caller.
10. It is the buyer’s full responsibility that purchased equipment complies with legal requirements before it is put into service. It is also the buyer’s full responsibility to obtain permission to use various software/patents, etc. from the respective rights holders.
11. Please notice the bid is binding and cannot be cancelled. Even if the reserve price is not meet, then the bid is still
12. The bid caller guarantees that the merchandise is free from encumbrances.
13. If no other agreement has been made, the purchased merchandise is to be removed for the buyer’s account. When collecting the merchandise, the buyer must present a receipted invoice. If a buyer has arranged for a carrier to collect the merchandise, the original, a photocopy, or a fax copy of the receipted invoice must be presented.
14. All traffic on the auction area is at one’s own risk.
