We do not in any circumstance offer a delivery service, or any packaging materials, and cannot assist in the moving of items, all items are sold in-situ. The pallets photographed are included in their present condition, we cannot provide extra pallets or replace pallets.
If you send a courier, all lots are loaded ‘as seen’ and any damage to items in transit is not the responsibility of the Auctioneer or the seller.
We are unable to give any information about the size or weight of lots in any circumstances.
After payment, you must give 24 hours notice for collection, we are unable release goods for collections without an appointment.

Please read this Important Information carefully before you place any bids in any of our auctions. You should read this in conjunction with the General Terms and Conditions of Sale below and any Supplementary Terms and Conditions and any Important Information that are stated in the online listing. All of this information along with the General Terms and Conditions of Sale below and any Supplementary Terms and Conditions sets out the legal relationships between us and creates a binding legal agreement when you register as a bidder. If you are in any doubt whatsoever do not register and do not place any bids!
In order to register as a bidder you are deemed to have accepted that you have read and accept that you are bound by all these Terms and Conditions referred to above.
Please do not to place any bids unless you are able to pay for your item/s within 4 days of the auction ending and collect your item/s within 6 days of the auction ending. For the avoidance of doubt we do not provide a delivery service for any of our lots without prior written arrangement. If you fail to pay for the lot as provided for in these Terms and Conditions, your registration with us may be suspended and blocked and you will be unable to bid on any other items until the registration has been lifted.
All lots are located at the premises of DB Auctions Middlewich. We do not permit children under 16 are to be on the premises at any time.
REGISTRATION
Before you are able to bid in our auctions you must first register with I-Bidder to set up an account. Please therefore ensure that you sign-up well in advance of the auction. If you delay until the day the auction is closing before registering it is likely that you will not be approved in time to bid .
Once you have registered then you must “log-in” to each specific auction that you wish to bid in. Please ensure that you read and understand the specific rules for each auction, and in particular ensure that you can make payment and collect the lot/s within the timescale set out in the particular auction rules.
We operate an approval system for registration. Your debit or credit card details may be used for the purposes of an identity check. If you fail the identity check, and/or have no bidding history or you have any history of having failed to pay any auctioneer previously and/or you are based overseas, you are likely to either be declined or sent a request for a “refundable deposit”.
We also make it clear that we cannot change the bidders details on the invoice so you must register in the name you wish the invoice to be addressed to. Do not give your password to anyone else – it is not a valid excuse after the auction ends to claim that a relative/employee/partner/friend/etc. bid on your account without your permission – the registrant will still be held liable for all bidding activity
Once you have set up your I-Bidder account, you may add the details of one or more credit or debit card (excluding AMEX). As auctioneers we can see the address you attach to each card, however we cannot see your full card details.
Please remember to update your details on I-Bidder on a regular basis to your ensure registration details are current in particular your payment method.
When you wish to place a bid in a particular auction, you will need to “sign-up” to that sale and follow the instructions.
As we manually approve bidders who pass the initial security check it can take some time after signing up before you are approved especially outside office hours and we suggest that you “sign up to auctions” well in advance. If you leave it till the end of scheduled auction there may well not be enough time to approve you.
We reserve the right to reject any bids that may be made if you fail to pass our security checks and we are not obliged you with our reasons
It is essential that you have all of the Terms and Condition and the specific rules for each auction all the rules before signing up to any particular auction.
VIEWING
All of our auctions have an open viewing day (the details of which are set out in the information regarding the particular auction) and bidders are reminded not to bid unless they have viewed the Lots in person, as it will be assumed to have viewed the Lots and inspected them to your satisfaction.
BIDDING
IMPORTANT: All lots are sold as seen - it is assumed in the act of bidding that all bidders have viewed lots prior. No allowance of any description whatsoever will be made in the event of any problems caused as consequence of your failure to view the Lot/s – we recommend that you not to bid on anything unless you have inspected it to your satisfaction first. We stress that the descriptions given and photos provided are insufficient to rely upon for the purposes of bidding.
Please note the sale will use `auto bid extension`. If a bid is placed with less than 10 minutes remaining (for that specific lot only) the end time automatically extends by a further 10 minutes. This will keep occurring until there is a 10-minute period with no bids.
ALL BIDS ARE LEGALLY BINDING AND CANNOT BE WITHDRAWN
VAT
All lots in our auctions are either subject to VAT at 20 % (or the current applicable rate) or are exempt from VAT. This is indicated in the Lot description.
For those who register with an address outside the UK, a VAT refund may be possible for those permanently exporting the items. You should make any necessary enquiry with the HMRC and provide us with any official documentation to facilitate this. For the avoidance of any doubt we do not provide the refund and you will have to arrange that with HMRC. If you register with a UK address, no refund of VAT will be possible under any circumstances.
If you will be looking to reclaim the VAT, you must inform us at the time of payment as claims only first registered weeks after the sale will be difficult to arrange.
Should you intend to export goods you have purchased and believe you may be eligible for the lot price to be zero-rated or be subject to a VAT refund for VAT purposes, it is important to consider the following;
BUYERS PREMIUM
A Buyer's Premium of 15% is applied to all Lots irrespective of whether the Lot price itself is exempt from VAT. VAT at 20% is applied to the Buyers Premium irrespective of whether the Lot is subject to VAT or not.
PAYMENT
Balances must be paid in full & all goods collected by the date specified in the auction listing. Please do not bid if there is in any doubt as to your ability to pay.
Once the Lot closes, we send out a “Winning Bidder Notification” via the I-Bidder platform, with details of all the lots you have won, together with VAT where applicable and Buyer’s Premium. Once in receipt of cleared funds in the full amount we will issue a VAT receipt. All balances must be paid in full by the date that appears in the Important Information section, which is typically just two or three working days after the sale closes.
You can pay by any of the following methods, however please note that we do not accept cheques or banker’s drafts under any circumstances.
Cash.
You may pay by cash either in person at our offices, or alternatively, by paying cash directly into our bank account. Please note that due to money laundering regulations, we cannot accept cash payments that exceed £9,000.
Bank/Electronic Transfer.
We are happy to take payments by bank transfer and in particular Faster Payment. Please remember to ensure that if paying by bank transfer, you use a method, which will reach our client account in time. Please ensure that you quote your paddle number when paying by this method.
Please note, that BACS payments tend to take excessive periods and may not clear in time. If paying from an overseas bank account, you will need to ensure that your bank can process the transfer in time and that all charges have been paid for both the sending and receiving banks.
Bank transfers must be cleared in our account prior to collection. Please quote your bidder number to assist us.
Please remember that cheques, banker’s drafts and AMEX are not acceptable under any circumstances.

COLLECTION
Generally it will not be possible to collect your item on the day that the auction ends. It is suggested that you phone the morning after the sale before coming to collect. Following the auction you will receive a ‘winning bidder notification’ email shortly, with details of the lots purchased & total balance owing. You will also receive a ‘payment request’ email, shortly after the ‘winning bidder notification’. You can pay by bank transfer or cash in person at our office.
Please remember unless agreed in writing with us. It must be assumed that we do not deliver or post any Lots. It is entirely your responsibility to collect. We do not arrange couriers on your behalf. Nor do we supply boxes or packing materials,
If you send a carrier, you must remember we will not assist in any way with the movement or packing or dismantling of the item in any way. You remain responsible for this at all times.
COLLECTION DEADLINE
It is important that you pay and collect on time. If you are late in paying and collection you will be charged a late collection/payment charge if you do not collect in time.
Lot/s not paid for and collected by the deadline applicable to the specific sale in question will be subject to a storage charge of either £25 per pallet per day - THERE ARE NO EXCEPTIONS.
Limitation of Liability
We accept no responsibility for any personal injury or damage caused to you or your property whilst you are on our premises save in accordance with health and safety regulations.
General Terms and Conditions of Sale
1. Applicability of General Terms and Conditions of Sale
These General Terms and Conditions of Sale ("Terms and Conditions’) apply to any and all sales conducted by DB Auctions Limited ("the Auctioneers"), whether they be Auctions, Tenders (whether formal or informal), Private Treaty or any other method of sale. These Terms and Conditions may be supplemented by additional or Special Terms and Conditions within the Auction/Tender catalogue or listing. In a sale by Tender or Private Treaty, the term "Auctioneers" shall mean "Agent", and the term "Auction" shall mean "Sale. In the event of any inconsistency between these Terms and Conditions and any "additional" or "Special terms and conditions within the Auction/Tender Catalogue or listing, the additional or special terms and conditions will prevail. These Terms and Conditions also include the "Important Information" that is published on the Auctioneers website.
2. Agency
The Auctioneers act as agents for the seller only. The Auctioneers have no responsibility for any default by either the buyer or seller. The Auctioneers do not provide any warranty or guarantee as to the title of any lot or lots sold by them, and will not in any circumstances be responsible for any defect in the title of any goods sold.

Notwithstanding the fact that title does not pass until the lots are paid for as referred to in clause 3 herein, each lot (apart from motor vehicles) shall be held uninsured at the buyer's sole risk as from the fall of the hammer, and are sold as seen with all faults, defects and imperfections. No responsibility is accepted for any loss of (or damage to) lots from the fall of the hammer.

Should a buyer fail to comply with any of these "General Terms and Conditions of Sale", and/or any special or additional Terms and Conditions relevant to the sale in question, and/or fails collect within the timescale stated in the catalogue, the Auctioneers reserve the right at its discretion to resell any such lot/s by public or private sale without reserve and without notice to the buyer. If upon resale as foresaid a lower price is obtained for any lot than was obtained at the first sale, then any such shortfall will be a debt due from the buyer in default in the first sale. Irrespective of the price the Auctioneers receive on resale, the buyer will be responsible for any and/all additional costs of the Auctioneers including storage at either £5.00 per lot per day, or 5% of the hammer price per lot per day (whichever being greater), advertising, handling, selling costs, insurance etc. Furthermore, the Auctioneers reserve the right in the alternative, to move lots outside the premises (at the buyer’s risk), if said lot/s are (in the Auctioneers’ opinion) restricting the use of the auction room.
10. Movement or Relocation of Lots
The Auctioneers reserve the right at its discretion to move any lots, which I their opinion are restricting the use of the auction premises and/or inhibiting collectors and/or need to be moved to assist in other activities taking place on the premises. Movement of assets in such circumstances is entirely at the buyer’s risk, and the Auctioneers bear no responsibility or liability for any loss or damage such as may be incurred during any such movement. The Auctioneers are not obliged to inform the buyer in advance if any lot/s require to be moved.
11. Damage
In the event of damage being occasioned to any lot or to the Auctioneer’s premises at the viewing or before, during or after a sale, such damage shall be the responsibility of the person committing such damage, principals being responsible for the actions of their servants, subcontractors and/or any other persons in the premises on their behalf, such damage to be assessed by the Auctioneers. Cutting or welding equipment or the use of explosives is strictly prohibited without the Auctioneers' express permission, in writing.

Upon the purchase of any lot/s the buyer is not entitled to transfer the said lot/s without the express written permission of the Auctioneers.
20. Searching of Vehicles

Vehicles may at the discretion of the Auctioneer be parked in the Auctioneers' car park, but only at the owner's risk. The Auctioneers may at their discretion limit such parking and impose any conditions associated with such parking at any time.
22. Road Traffic Act Provisions
23. Export of Goods
The sale of goods described in the auction catalogue shall not either expressly or by implication indicate that any Department of Trade and Industry Licence for export of goods in their present (or modified condition) will or may be granted to the buyer. The application for any such licence remains at all times entirely a matter for the buyer.
24. VAT
Any buyer intending to export items purchased at the auction must pay any Value Added Tax in the normal way and make their own arrangements with HMCR in relation to any refund, if appropriate.
25. Rescission By Seller
Following the sale and in the event of the seller being unable to provide a "good and sufficient title" to or delivery of any lot or part thereof before its removal, or if in seller's opinion the removal of such any lot will endanger or permanently damage any building or other property, the seller may by written notice to the buyer of such lot, delivered to him or his agent or sent by first class post to his last known place of abode or business last known to the Auctioneers, rescind the sale of such lot and repay the buyer any deposit or purchase money paid in respect thereof without deduction.
26. Indemnity
The buyer shall indemnify the Auctioneers and the seller in any actions resulting from the buyer's failure to observe the obligations and these Terms and Conditions generally but particular reference is drawn to Clauses 12.2, 16.2, 18.3, 23 and 30 herein.
27.Variations
No member of the Auctioneer’s staff is authorised to make any variations to these terms and conditions unless so authorised in writing by a Director.
28. Applicable law
These Terms and Conditions are subject to the laws of England and Wales irrespective of the location or domicile of the parties to the agreement. The Auctioneers unilaterally and solely reserve the right to require that any dispute be determined by arbitration in accordance with the Arbitration Act 1996 or replacement statutory provision.
29. Severability
In the event that any provision within these Terms and Conditions is found to be unlawful or invalid such does not prevent the remaining and unaffected provisions from being binding on the parties.
SPECIAL NOTICES
30. Misrepresentation Act 1967
The auction catalogue or any part of it does not constitute any part of an offer or contract. All prospective buyers attention is specifically drawn to the Terms and Conditions within the catalogue or listing in addition to these General Terms and Conditions of Sale. For the avoidance of doubt, all statements contained in the catalogue or listing as to the lots, are made without responsibility on the part of the Auctioneers or the seller. Any prospective buyer must confirm by inspection or otherwise the accuracy of any descriptions, quantities, etc., contained within this catalogue and no statements herein are to be relied upon as statements or representations of fact. For the avoidance of doubt, neither the sellers nor the Auctioneers, nor any servant or agent or any person in the employ of either of them have any authority to make or give any representation or warranty.
29. Unfair Contract Terms Act 1977
Prospective buyers should note that sales by auction are not consumer sales for the purpose of the Unfair Contract Terms Acts, 1977.
30. Sale of Goods Act 1979
No lot is warranted or held out to be merchantable or safe for use or complying with statutory for use, display or movement.
Neither the Auctioneers nor the sellers, nor their servants and agents have any authority to make any representations unless indicated to the contrary.
30. Health and Safety at Work Act 1974
The goods are not sold as articles for use at work, or at home, and they are sold on the strict understanding that the seller does not represent them as being in a condition which makes them suitable or safe for use at work or home. Any oil/gas fired, electrical appliances, machinery, plant or equipment are sold as scrap or for refurbishment only, and in their current condition are not necessarily compliant with the requirements of the Health and Safety at Work Act 1974 and the Consumer Protection Act 1987. All buyers should understand that before any item/s sold are subject to use, they must undertake to refurbish the items and render them compliant with the aforementioned acts.

A Buyer's Premium of 15% is applied to all Lots irrespective of whether the Lot price itself is exempt from VAT. VAT at 20% is applied to the Buyers Premium irrespective of whether the Lot is subject to VAT or not.
PAYMENT
Balances must be paid in full & all goods collected by the date specified in the auction listing. Please do not bid if there is in any doubt as to your ability to pay.
Once the Lot closes, we send out a “Winning Bidder Notification” via the I-Bidder platform, with details of all the lots you have won, together with VAT where applicable and Buyer’s Premium. Once in receipt of cleared funds in the full amount we will issue a VAT receipt. All balances must be paid in full by the date that appears in the Important Information section, which is typically just two or three working days after the sale closes.
You can pay by any of the following methods, however please note that we do not accept cheques or banker’s drafts under any circumstances.
Cash.
You may pay by cash either in person at our offices, or alternatively, by paying cash directly into our bank account. Please note that due to money laundering regulations, we cannot accept cash payments that exceed £9,000.
Bank/Electronic Transfer.
We are happy to take payments by bank transfer and in particular Faster Payment. Please remember to ensure that if paying by bank transfer, you use a method, which will reach our client account in time. Please ensure that you quote your paddle number when paying by this method.
Please note, that BACS payments tend to take excessive periods and may not clear in time. If paying from an overseas bank account, you will need to ensure that your bank can process the transfer in time and that all charges have been paid for both the sending and receiving banks.
Bank transfers must be cleared in our account prior to collection. Please quote your bidder number to assist us.
Please remember that cheques, banker’s drafts and AMEX are not acceptable under any circumstances.
PLEASE NOTE THAT WE DO NOT TAKE CARD PAYMENTS OF ANY DESCRIPTION OVER THE PHONE.
COLLECTION
Generally it will not be possible to collect your item on the day that the auction ends. It is suggested that you phone the morning after the sale before coming to collect. Following the auction you will receive a ‘winning bidder notification’ email shortly, with details of the lots purchased & total balance owing. You will also receive a ‘payment request’ email, shortly after the ‘winning bidder notification’. You can pay by bank transfer or cash in person at our office.
Please remember unless agreed in writing with us. It must be assumed that we do not deliver or post any Lots. It is entirely your responsibility to collect. We do not arrange couriers on your behalf. Nor do we supply boxes or packing materials,
If you send a carrier, you must remember we will not assist in any way with the movement or packing or dismantling of the item in any way. You remain responsible for this at all times.
COLLECTION DEADLINE
It is important that you pay and collect on time. If you are late in paying and collection you will be charged a late collection/payment charge if you do not collect in time.
Lot/s not paid for and collected by the deadline applicable to the specific sale in question will be subject to a storage charge of either £25 per pallet per day - THERE ARE NO EXCEPTIONS.
Limitation of Liability
We accept no responsibility for any personal injury or damage caused to you or your property whilst you are on our premises save in accordance with health and safety regulations.
General Terms and Conditions of Sale
1. Applicability of General Terms and Conditions of Sale
These General Terms and Conditions of Sale ("Terms and Conditions’) apply to any and all sales conducted by DB Auctions Limited ("the Auctioneers"), whether they be Auctions, Tenders (whether formal or informal), Private Treaty or any other method of sale. These Terms and Conditions may be supplemented by additional or Special Terms and Conditions within the Auction/Tender catalogue or listing. In a sale by Tender or Private Treaty, the term "Auctioneers" shall mean "Agent", and the term "Auction" shall mean "Sale. In the event of any inconsistency between these Terms and Conditions and any "additional" or "Special terms and conditions within the Auction/Tender Catalogue or listing, the additional or special terms and conditions will prevail. These Terms and Conditions also include the "Important Information" that is published on the Auctioneers website.
2. Agency
The Auctioneers act as agents for the seller only. The Auctioneers have no responsibility for any default by either the buyer or seller. The Auctioneers do not provide any warranty or guarantee as to the title of any lot or lots sold by them, and will not in any circumstances be responsible for any defect in the title of any goods sold.

Notwithstanding the fact that title does not pass until the lots are paid for as referred to in clause 3 herein, each lot (apart from motor vehicles) shall be held uninsured at the buyer's sole risk as from the fall of the hammer, and are sold as seen with all faults, defects and imperfections. No responsibility is accepted for any loss of (or damage to) lots from the fall of the hammer.

Should a buyer fail to comply with any of these "General Terms and Conditions of Sale", and/or any special or additional Terms and Conditions relevant to the sale in question, and/or fails collect within the timescale stated in the catalogue, the Auctioneers reserve the right at its discretion to resell any such lot/s by public or private sale without reserve and without notice to the buyer. If upon resale as foresaid a lower price is obtained for any lot than was obtained at the first sale, then any such shortfall will be a debt due from the buyer in default in the first sale. Irrespective of the price the Auctioneers receive on resale, the buyer will be responsible for any and/all additional costs of the Auctioneers including storage at either £5.00 per lot per day, or 5% of the hammer price per lot per day (whichever being greater), advertising, handling, selling costs, insurance etc. Furthermore, the Auctioneers reserve the right in the alternative, to move lots outside the premises (at the buyer’s risk), if said lot/s are (in the Auctioneers’ opinion) restricting the use of the auction room.
10. Movement or Relocation of Lots
The Auctioneers reserve the right at its discretion to move any lots, which I their opinion are restricting the use of the auction premises and/or inhibiting collectors and/or need to be moved to assist in other activities taking place on the premises. Movement of assets in such circumstances is entirely at the buyer’s risk, and the Auctioneers bear no responsibility or liability for any loss or damage such as may be incurred during any such movement. The Auctioneers are not obliged to inform the buyer in advance if any lot/s require to be moved.
11. Damage
In the event of damage being occasioned to any lot or to the Auctioneer’s premises at the viewing or before, during or after a sale, such damage shall be the responsibility of the person committing such damage, principals being responsible for the actions of their servants, subcontractors and/or any other persons in the premises on their behalf, such damage to be assessed by the Auctioneers. Cutting or welding equipment or the use of explosives is strictly prohibited without the Auctioneers' express permission, in writing.

Lots sold after the auction (are unless stated to the contrary) subject to these General Terms and Conditions of Sale, applicable if the lots had been sold during the auction.

Vehicles may at the discretion of the Auctioneer be parked in the Auctioneers' car park, but only at the owner's risk. The Auctioneers may at their discretion limit such parking and impose any conditions associated with such parking at any time.
22. Road Traffic Act Provisions
23. Export of Goods
The sale of goods described in the auction catalogue shall not either expressly or by implication indicate that any Department of Trade and Industry Licence for export of goods in their present (or modified condition) will or may be granted to the buyer. The application for any such licence remains at all times entirely a matter for the buyer.
24. VAT
Any buyer intending to export items purchased at the auction must pay any Value Added Tax in the normal way and make their own arrangements with HMCR in relation to any refund, if appropriate.
25. Rescission By Seller
Following the sale and in the event of the seller being unable to provide a "good and sufficient title" to or delivery of any lot or part thereof before its removal, or if in seller's opinion the removal of such any lot will endanger or permanently damage any building or other property, the seller may by written notice to the buyer of such lot, delivered to him or his agent or sent by first class post to his last known place of abode or business last known to the Auctioneers, rescind the sale of such lot and repay the buyer any deposit or purchase money paid in respect thereof without deduction.
26. Indemnity
The buyer shall indemnify the Auctioneers and the seller in any actions resulting from the buyer's failure to observe the obligations and these Terms and Conditions generally but particular reference is drawn to Clauses 12.2, 16.2, 18.3, 23 and 30 herein.
27.Variations
No member of the Auctioneer’s staff is authorised to make any variations to these terms and conditions unless so authorised in writing by a Director.
28. Applicable law
These Terms and Conditions are subject to the laws of England and Wales irrespective of the location or domicile of the parties to the agreement. The Auctioneers unilaterally and solely reserve the right to require that any dispute be determined by arbitration in accordance with the Arbitration Act 1996 or replacement statutory provision.
29. Severability
In the event that any provision within these Terms and Conditions is found to be unlawful or invalid such does not prevent the remaining and unaffected provisions from being binding on the parties.
SPECIAL NOTICES
30. Misrepresentation Act 1967
The auction catalogue or any part of it does not constitute any part of an offer or contract. All prospective buyers attention is specifically drawn to the Terms and Conditions within the catalogue or listing in addition to these General Terms and Conditions of Sale. For the avoidance of doubt, all statements contained in the catalogue or listing as to the lots, are made without responsibility on the part of the Auctioneers or the seller. Any prospective buyer must confirm by inspection or otherwise the accuracy of any descriptions, quantities, etc., contained within this catalogue and no statements herein are to be relied upon as statements or representations of fact. For the avoidance of doubt, neither the sellers nor the Auctioneers, nor any servant or agent or any person in the employ of either of them have any authority to make or give any representation or warranty.
29. Unfair Contract Terms Act 1977
Prospective buyers should note that sales by auction are not consumer sales for the purpose of the Unfair Contract Terms Acts, 1977.
30. Sale of Goods Act 1979
No lot is warranted or held out to be merchantable or safe for use or complying with statutory for use, display or movement.
Neither the Auctioneers nor the sellers, nor their servants and agents have any authority to make any representations unless indicated to the contrary.
30. Health and Safety at Work Act 1974
The goods are not sold as articles for use at work, or at home, and they are sold on the strict understanding that the seller does not represent them as being in a condition which makes them suitable or safe for use at work or home. Any oil/gas fired, electrical appliances, machinery, plant or equipment are sold as scrap or for refurbishment only, and in their current condition are not necessarily compliant with the requirements of the Health and Safety at Work Act 1974 and the Consumer Protection Act 1987. All buyers should understand that before any item/s sold are subject to use, they must undertake to refurbish the items and render them compliant with the aforementioned acts.
