VAT is payable on all lots unless otherwise stated.

 

BIDDING

All registrations for this auction are provisional and subject to the approval of the auctioneer. If your registration has not been approved, please telephone 07803 089558 on the morning of the sale.

 

If, at the time of placing your highest bid the reserve has not been met, it may be treated as a valid bid and the Lot may be knocked down to you once the sale has closed.

 

All details are provided in good faith. They should not be relied upon as fact and buyers must make their own investigations where measurements, mileages, hours, condition or authenticity are critical. Buyers should make themselves satisfied they are happy with the lot before they bid as viewing is available on all lots by prior appointment, all bids are non-retractable.

 

Potential purchasers who do not inspect lots prior to bidding, do so at their own risk.

 

CONDITION

The condition and function of an item should be confirmed by the bidder, prior to bidding as there will be NO Refunds or Allowance given after the closure of the bidding process. Your bid is your commitment to purchase, and there will not be opportunities to view or re-negotiate after the sale has closed.

 

Any bidders who do not pay or refuse to adhere to Durrants Terms and Conditions will be reported to i-bidder and blocked from bidding at any future sales hosted by i-bidder.

PAYMENT

All payments must be made in £’s sterling.

 

All items purchased must be paid upon receipt of the invoice sent by the auctioneers and within 5 working days of the auction date.

 

We will only accept the following payment methods:

1. Debit card (subject to the Terms & Conditions of sale)

2. Personal cheque (clearance of the cheque or bank guarantee required before goods leave, see below)

3. Bank/building society guaranteed cheque or draft

4. Sterling draft

5. Bank to bank transfer

6. Cash payment up to £7500.

 

In order to comply with the Money Laundering Regulations 2003, we are unable to accept cash payments for the sums in excess of £8,500. This includes single payments amounting to this sum or multiple payments totalling £8,500.

 

We are also unable to accept any cash payments paid directly into our bank account.

 

INVOICE ALTERATIONS

After the sale day, we are unable to change or amend any invoice(s). This includes changing the VAT status of the purchaser, name and address of the purchaser etc. Lots are also unable to be transferred between purchasers after the sale day. There will be no exception to this rule.

 

BUYERS FROM OTHER E.C. COUNTRIES

Under the E.C. regulations, goods purchased at our Sale will be ZERO RATED for VAT purposes subject to ALL of the following conditions being met:-

1. The Auctioneers are in possession of your VAT/FISCAL NUMBER (which will be verified with UK Customs and Excise) at the time of purchase IN ADDITION to a copy of your VAT registration certificate.

2. The Goods are sent or transported out of the UK to a destination in another EC Member State.

3. The Auctioneers receive valid commercial documentary evidence that the goods have been removed from the UK within three months of the date of the sale.

If you are not registered for VAT in your member state or are unable to provide us with any of the above information, VAT at the UK standard rate will be payable and WILL NOT BE RECLAIMABLE.

 

BUYERS FROM OUTSIDE THE E.C.

A VAT DEPOSIT equivalent to the standard rate of UK VAT (currently 20%) will be charged on all lots which are being exported outside the EC.

Refunds of VAT deposits will be dealt with under H.M. Customs and Excise regulations as set out in the current Notice 703. The minimum requirement of satisfactory evidence of export required to allow a refund is an original Bill of Lading or Certificate of Shipment issued by a recognised Shipping/Transport Company or a S.A.D stamped by Customs & Excise and clearly identifying the goods which have been exported.

 

RESERVES

There may be reserves on the Lots included in the Auction, therefore when you are placing a bid, you are bidding to buy.

 

We reserve the right to withdraw any item from sale at any time.

 

COLLECTION

All purchased lots should be collected not later than 7 days after the end of the sale. Removal of lots is subject to clearance of cheques, bank transfers, and so forth. Any items left after this date will either be disposed of or offered for sale in a subsequent auction without reserve. 

Terms & Conditions

CONDITIONS OF SALE

1.   Bidding - The highest approved bidder shall be the purchaser. No bidding to be retracted. Each purchaser shall give up his (or her) name and address when asked for. Should any dispute arise between two or more bidders, the lot in dispute shall be put up again and resold; and the Auctioneers reserve to themselves the right of refusing any person's bid, and shall be the sole Arbitrators on any matter in dispute during the sale. The vendor also reserves the right to bid by his agent.

2.   Description - No warranty is given or implied by the description in the catalogue. Each lot is sold in its condition at the time of sale with all faults, defects, imperfections and errors of description (if any). Whilst every endeavour has been made to describe the items adequately and properly, the purchaser shall deem to have inspected the lot at time of purchase.

3.   Variation of Lots - Auctioneers reserve the right to withdraw, consolidate or divide any lot or lots or submit them in any order that they deem desirable.

4.   Payment - All lots shall be paid for upon the day of the sale and the Auctioneers reserve the right to refuse delivery when payment is proposed by cheque and the purchaser are unknown to them. To avoid such inconvenience payment should be made by cash, bankers draft or debit card (in person only) and any alternative form of payment (by those unknown to the Auctioneers) must be arranged with the Auctioneers prior to the Sale. (All items purchased through i-bidder are subject to 3% plus VAT administration charge.)  After the fall of the hammer, the lot shall be at the purchaser’s risk. It is expressly stated that the Auctioneers will not be responsible for its safe custody. Due to Money Laundering Regulations 2007, the Auctioneers cannot accept cash payments in excess of £8,500 (inc. VAT) from any one person. All money received will be held in George Durrant & Sons Ltd (Durrants) Clients Account at Barclays Bank plc.

5.   Non Payment - If the purchaser defaults with his payment the Auctioneer shall be at liberty to recover by process of law, against the purchaser the cost of any lot or lots brought by him, without reference to the purchaser, dispose of such lots as the Auctioneer sees fit. If there is a surplus on resale the Auctioneer shall have the right to appropriate the same, or if a deficiency, to recover from the purchaser such deficiency.

6.   Heath and Safety - Purchasers will be deemed to have satisfied themselves prior to purchasing regarding current legal requirements (e.g Health & Safety at Work Act) and it is expressly brought to the bidders attention that equipment in the sale may not necessarily comply with such regulations. Any purchaser shall satisfy himself as to any statutory requirement for the use of any item and no liability shall rest with the vendors nor the Auctioneers.

      All electrical items require a current Electrician’s Safety Certificate and any item delivered without a Certificate will either be refused entry or have the lead and plug removed and sold as scrap. Where electrical equipment is sold without specific instructions for use it is the responsibility of the Purchaser to take independent advice as to the correct operating procedures and any characteristics specific to them. The Auctioneers and Vendor shall have no responsibility for the safe use of the item.

7.   Personal Safety - Neither the vendors nor the Auctioneers will be held responsible for any injury, damage or accident caused to persons or their property whilst at the property.  This is private property and persons enter the premises at their own risk.

8.   Purchasers shall pay for any damage done by themselves or their agents during the removal of their lots. Attendance at the sale shall be at the risk of those attending to both themselves and to their goods and vehicles.

 

AUCTIONEERS’ REMARKS AND SPECIAL NOTICES

1.          VAT - VAT will be added to the hammer price unless otherwise stated at time of sale. Export: if any items are to be exported outside E.C. VAT will be charged in the normal way and held by the Auctioneers until a customs clearance note is secured; the VAT will then be refunded. If confirmation of export is not secured within two months the VAT will be paid to the vendor and declared in the normal way. If items are to be exported within the E.C. proof of VAT registration number and confirmation of port for export will be required; otherwise VAT will be charged.

2.          Internet Bidding – Internet bidding will be available through i-bidder. All items purchased through i-bidder are subject to a 3% plus VAT i-bidder charge.

3.          Buyers Premium - A buyer’s premium of 3% plus VAT will be added to all purchases.

4.          Payment – All lots must be paid for on the day of the sale. Payment can be made by cash, cheque or debit card, please note credit cards and American Express are NOT accepted. The Auctioneers reserve the right to refuse delivery when payment is proposed by cheque and the purchaser are unknown to them. To avoid such inconvenience payment by cheque must be arranged with the Auctioneers prior to the Sale.

5.          Viewing - 29th June between 2pm and 5pm or on the morning of the sale.

6.          Removal of Goods -  Some of the lots may be in a building and lots in the buildings cannot be removed whilst the sale is continuing in that building. Subsequent lots can be removed during the sale and subject to conditions regarding payment. All lots must be removed within 7 days of the sale date, any lots left after this date may be sold to cover costs. Attention is drawn to purchasers responsibility after the sale as stated in the Conditions of Sale.

7.        Loading Loading facilities will be available on the sale day and the following day, thereafter strictly by appointment.

8.        Hours and Mileage - Where mentioned they are at times of cataloguing. Registration documents (where available) will be supplied after clearance of payment.

9.        Refreshments -  A refreshment van will be in attendance.

11.        Catalogue Entries – Whilst every attempt is made to ensure that the descriptions are accurate, no guarantees are either given or implied.
