WEEKLY AUCTION

Established as one of the biggest weekly sales of end-of-line-and surplus stocks from major manufactures, importers and retailers, Gascoines is ideally situated on the outskirts of Newark in Nottinghamshire.

Its location makes it easily accessable from all parts of the UK by either motorway or rail - a major advantage to both vendors and buyers hauling goods to and from the salesroom. Buyers from as far away as the south coast and Scotland have a firm date each week to be at Gascoines.

TERMS AND CONDITIONS

General Conditions of Sale as issued by Gascoines Auctioneers and Valuers

The Internet auction site is not an online retailer - the auction site is effectively acting as just a host to the sellers. This means that the Internet auction site is not responsible for the content of the advertisements placed. Unlike their live auction house counterparts, an online auction site will have no legal obligations in relation to the goods advertised for sale on its website.

The following Conditions of sale must be strictly adhered to and regulate the sale of each Lot to any Vendor, Bidder or Buyer who has been approved by Gascoines Auctioneers and Valuers (henceforth referred to as the Auctioneers). By participating in a sale, you will be judged to have read, understood and accepted these terms and are therefore bound by them.

The images (web links) may not match exactly to the Lot description. Colours or patterns may vary

All persons partaking in the auctions do so at their own risk. Under no circumstances will the Auctioneers, or the vendor be individually or collectively held responsible for any loss of damage caused to individuals or their property present on the Auction centre site or car park.

The Auctioneers reserve the right to refuse approval to any Buyer or online Bidder at the former’s own discretion.

CONDITIONS REGULATING the Conduct of the Sale

The highest bidder acknowledged as such by the auctioneers will be the buyer. In the event of doubt, on the part of the auctioneers as to the validity of any bid, the Auctioneers will have absolute discretion to determine the successful bidder, cancel the sale, re-sell the Lot or take any such remedial action the Auctioneers sees fit.

WARNING: Many of the pieces sold are factory seconds, end of line, surplus stock returns  second hand or customer returns and may in some way be damaged, incomplete or faulty. It is not the Auctioneers’ responsibility to inform of any damages. All items are purchased at the Buyer or Bidders own risk and no guarantees or warranties can be provided by the Auctioneers.

Trademarks and Branding

Lots in any auction that have been physically de-branded must remain de-branded. No original trademarks or vendor/client logos or images may be copied or used by the successful Bidder in any circumstance. Any Buyer deemed in breach of this risks permanent exclusion from future auctions.

Please be aware that Gascoines Auctioneers and valuers charge a Buyer’s Premium of 15% for auction services on all Lots sold. Buyer’s premium is also subject to the addition of VAT at the current rate.

Please note that there is also a 5% i-bidder internet surcharge for all purchases made online.

The highest accepted Bidder, subject to the Vendors Reserve (if any) is deemed the successful buyer.

Every bidder shall be deemed to act as principal, unless there is a prior arrangement with the Auctioneers that he acts as an agent on behalf of a named principal.

The Auctioneers reserve the right to refuse to accept bids from any person without stating a reason.

The Auctioneers reserve the right on behalf of themselves and the Vendor:

. To set a reserve price

. To rearrange, consolidate or withdraw any Lot(s)

. To vary the order of the sale

The Auctioneers shall not be obliged to announce the reserve price

No Person may advance on any bid less than the sum named by the Auctioneers.

No bidding may be retracted unless authorised by the Auctioneers.

Under no circumstances may the transferring of any Lot(s) from individuals or agents to any other parties be allowed on site.

No estimates made by the Auctioneers or their employees, whether in writing or orally, maybe relied upon ad a prediction of the actual selling price.

PAYMENT AND COLLECTION

Lots FOR THE SMALLS ONLINE TIMED AUCTION are to be PAID FOR and COLLECTED by 4 WORKING DAYS following /after the sale. Any Lots uncollected by this time will be subject to a daily storage charge, the Buyer will incur a daily storage charge of £5+VAT per item per day, without exception.

INVOICES WILL BE CANCELLED FROM 17.00 ON THE FOURTH WORKING DAY AFTER THE SALE

Payments for Lots purchased must be made by cash(sterling), debit card and most major credit cards.

Business cheques can only be accepted by prior arrangement.

The Auctioneers as agents of the vendor, shall at its absolute discretion and without prejudice to any other rights it might have, be entitled:

. To rescind the contract for sale of the Lot(s) sold to the defaulting Buyer at the auction

. To retain the Deposit and to pursue the Buyer directly for all monies owed.

. To enter the Lot(s) to be re-sold; the defaulting Buyer must pay the original invoice. Once this has been paid, we can arrange for the Lot(s) to re-sold.

. To remove, store (either at the premises or elsewhere) and insure, is necessary, the Lot(s) at the expense or the defaulting Buyer.

. To retain that or any other Lot(s) sold to the same Buyer at the same or any other auction and release it only after payment of the hammer price.

. To reject any bids made by or on behalf of the defaulting Buyer at any future auctions.

 

Credit will not be given to any Buyer.

The Auction result is final. Once your bid has been accepted, it is binding. This also applies to commission bids. Once an item has been sold, it becomes the Buyers responsibility. However, the Buyer is not entitled to move any Lot(s) until it is paid for in full.

Gascoines Auctioneers and Valuers offer no assurances or guarantees on any Lot(s) that we sell. We can offer no refunds, nor do we accept the return of goods, once your bid has been successful.

Lots purchased  in the smalls auction can be paid for and collected up to 4 working days after the sale. All items must be collected by 4 working days following / after the weekly  auction (unless you have made a prior arrangement with the staff). Storage charges of £5+VAT per item, per day will be incurred on goods not collected within the allotted time. Any item held in storage is done so at the Buyers own risk. The Auctioneers are not responsible for any damage that may occur. (Example - 1 lamp and 2 curtains would be £15 + vat a day for storage

Access for the purpose of removal of Lot(s) will be given only during normal business hours.

The Buyer is responsible for any labour and equipment necessary to collect their Lot(S) and must comply with any directions which may be given by staff.

The Buyer shall be responsible for any damage done to adjoining or other Lot(s) or to the Premises by the removal of their Lot(s) caused by the Buyer, their agents or carriers employed by him. Such damage must be made good or at the expense of the Buyer. Any estimated cost of repair is to be fixed by the Auctioneer, whose decision is binding to the Buyer.

The Buyer is also responsible for any loss of damage to any person resulting from the removal of the Lot(s) and indemnifies the vendor or the Auctioneer against any liability whether or not such damage was caused by the negligence of the Buyer or his agent.

ON LINE BIDDING

The Auctioneers do not accept liability for the placing of bids on i-bidder, or for the failure in any way for purchasers failing to secure their preferred Lot(s). The Auctioneers will not be held responsible for any failure of the internet or related hardware and software. Furthermore, they reserve the right to cancel an auction and re-offer Lot(s) if they suspect any undue interference or tampering with the on-line bidding system.

Delivery

For the online small goods auction Gascoines can offer a parcel postage service 1st or 2nd class dependent on when goods are paid for

For larger items Gascoines Auctioneers and Valuers offer a limited one man delivery service by prior arrangement. However, this does not include freight or pallet deliveries and only applies door to door. ( So help at receiving of goods is required)

We do not offer any installation services.

Insurance and Risk

Goods are held at the vendors risk until sold. Ownership is conferred to the Buyer on the fall of the hammer

All goods purchased are the Buyers responsibility from the moment they are sold to him, on the fall of the Auctioneers hammer. The Buyers should make his own insurance arrangements from this point.

The Auctioneers will take reasonable care of the goods whilst they are on the premises and  in the event of staff members helping to remove the goods after the sale

Liability for Accidents

 

The Buyer must undertake such reasonable and practical steps as are sufficient to ensure that the purchase will be safe and without risk to health and safety when properly used.

The Auctioneers will not accept liability for any accidents or injury sustained by any person or persons who may attend the premises for the auction, inspection, purchase, collection of any other business.

Disputes

In the event of any disputes arising, these general conditions of Sale shall prevail. The Auctioneers reserve the right to escort persons from the premises.

Amendments

The Auctioneers have the right to revise or amend these terms to reflect implementations or conditions.

Privacy

The Auctioneers are committed to the privacy of our users and will only use personal information given to provide auction services.

General

No waiver by the Auctioneers of any of these terms shall be enabled unless the Auctioneer expressly says that it is a waiver and the Auctioneers tell the Buyer and vendor in writing. If the Auctioneers do not exercise any of its rights or remedies under these terms, that will not mean that the Auctioneers have waived any of its rights and will not mean that the buyer does not have to comply with the Terms

In the event that any provision of the Condition of sale should be held unenforceable for any reason, the remaining terms shall remain in full force and effect.

These Terms are governed by English Law and the Auctioneers, the vendors and the Buyer all agree to the exclusive jurisdiction of English courts.

FAQs

Where do the goods that Newark Auction centre sell come from?

A  Most of the goods we auction are end of line , surplus stock , cancelled orders or returns from major manufactures, importers and retailers. We also have a regular supply of goods from house clearances, bankrupt stock and liquidations, new stock and ex - display

Q  Can the public sell items in the auction?

A Firstly, please send a photo via email. Tell us the price you would like to achieve and the auctioneer will let you know what he thinks he can sell for. Then bring the item in on a Monday, Tuesday or Friday.

Q Do you deliver?

A  For the online smalls auction we can parcel post . There is a charge of 1st or 2nd class.

The buyer must collect any goods by fourth day after the sale

For the main large auction we deliver items purchased in the sale, there is a charge, depending on the location of the delivery. Please ask at the office when requiring a delivery.

Buyers from the main large auction must collect by 12noon on the Monday following the auction or a storage fee is added at £5 per day + VAT, per item. It is the responsibility of the buyer to be aware of these charges and to remove goods before Monday 12noon.

Q  Are there any charges to the buyer?

A  Most Lot(s) are subject to 15% (+VAT) Buyers premium. Please ask if not sure.

Q  What is a Buyers premium?

A  Buyers premium is a charge applied to the hammer price for auction services.

Q  What does it cost?

A  At the auction. If the hammer price is £100 and the lot you have bought is subject to VAT you will pay:

Hammer price                         £100

VAT on hammer price             £20

Buyers premium@15%           £15

VAT on premium                     £3

Total                                        £138

If the hammer price is £100 and the Lot is not subject to VAT:

Hammer Price                         £100

Buyers Premium@15%           £18

Total ( inc. VAT on Premium) £118

Q  Do you require a deposit?

A  There is no deposit required to take part in the small online auction.

For the large auction at the Auction Centre all buyers are required to lodge a £200 refundable cash deposit. If you are not successful with your bidding this will be returned to you at the end of the sale ( approx 3pm). If you are successful with your bidding, your cash deposit can be used to pay in full or part pay for the items you have bought. If you would prefer you can have your cash back and pay for your items by debit or credit card. Please note if you are looking at purchasing a lot which is less than £200 you can leave a commission bid then all we take is a deposit to the value of your maximum bid.

Q  What is a ‘Lot’?

A  ‘Lot’ is the name given to the item or collection of items being auctioned.

Q  How do I know if a particular Lot is in good condition?

A  All lots are sold as seen and no guarantees or warrantees can be provided by Newark Auction centre of the vendor. All purchasers are strongly recommended to physically examine the lots to their satisfaction prior to bidding. IF IN DOUBT DO NOT BID.

Q  Can I try the goods?

A  There is no viewing for the smalls auction, there will be photos on line.

For the large auction at the Auction Centre It is strongly recommended that where possible you try or test the lots prior to bidding. All lots are sold as seen and no guarantees or warrantees can be provided by Newark Auction centre or the vendor. IF IN DOUBT DO NOT BID.

Q  When do your auctions take place?

A  The timed smalls auction takes place online every 13 days from Friday – to - Wednesday.

The large auction is every Thursday at Newark Auction Centre and online (Ibidder), both start at 10am.

Q  When and where can I view the lots?

A There is no viewing for the smalls auction, there will be photos on line.

 For the large auction at the Auction Centre Viewing in person is from 12noon until 7pm on a Wednesday and from 8.30am on the sale day ( Thursday) until 10.00 when the sale starts. You can also view our catalogue online www.newarkauctioncentre.com.

Q  How long does the auction last?

A  The smalls online auction is timed and runs for 13 days at a time

The large auction at the Auction Centre is approximately four hours.

Q  How do I bid at the auction?

A1 For the online smalls auction.

It is a timed auction so keep an eye on your preferred lots, watch to see if anyone puts on a bid. if you want to put in a larger bid to try and secure the item then feel free to do so up until the time the auction runs out.

A2  Bidding at an auction is a fun and exciting way to buy.

For the large auction at the Auction Centre

If it is your first time at an auction please do not worry, our staff are very experienced and will be happy to explain the process to you. We recommend that you arrive in plenty of time to allow yourself to fully inspect any lots that you are interested in. This will also allow you to adjust to the patter and sequences that the auctioneer uses when taking bids.

Once you have registered you will be given a buyers number. It might be helpful to write  the number on the front of your catalogue to help you remember it. When the auctioneer arrives at the Lot you are interested in, use your hand or catalogue to make yourself seen. Don’t worry if the auctioneer is already taking bids as he will come to you when one bidder drops out. (The auctioneer can only take bids from two competing bidders at any one time).

Once you have the auctioneers attention you can reduce the size of your gesture. The auctioneer will always try to have eye contact.

Simply continue to bid on the lot(s) that you are interested in until you are successful or until you decide to drop out of the bidding. If you are the highest bidder you will be asked by the auctioneer for your buyers number.

When the auction is finished in your area of the room and the auction results have been submitted and updated in the office, make your way to the office to settle your invoice and arrange collection of your goods. 

All buyers must find a member of staff to mark out the items being taken. It is advisable to bring your own help to load your vehicles. Porters are around to help but it cannot be guaranteed they will be available.

Remember: if you have any questions on sale day, staff are happy to help

 

Q  What is a commission bid?

A  If you cannot stay for the duration of the auction you can leave a commission bid for the lots you are interested in. You will fill out a form with the lot numbers that you want to bid on and the maximum ’hammer price’ that you are prepared to pay (don’t forget Buyers Premium  and VAT will be added to the hammer price). You can then leave us with a cash deposit of your total ‘hammer price’ bid or £200 (which ever is lower) and leave the rest to us. If you leave a bid of £100 and the bidding ends at £60, you will pay £60 + commission +VAT (if applicable)

The Auctioneer will bid on your behalf up to your maximum bid, we do not start the bidding on your maximum bid. You can phone us after 4pm on sale day to see if you were successful and how much your bid was (don’t forget your commission bid is the maximum hammer price you will pay, your successful bid may well be lower than the maximum you were prepared to pay). Please note we make no additional charges for commission bids!

Q  I’ve never been to an auction before, will I buy anything by mistake?

A  Do not worry, it is really difficult to buy something by mistake at auction. The popular view of scratching your nose or waving to a friend during an auction and you end up buying something you do not want only really happens in films and television. Our auctioneers are very experienced and would not let this happen to you.

Q  What if don’t buy anything, do I get my money back?

A  Yes your deposit is refundable.

Q  If I bid successfully when do I pay for my goods?

A  Shortly after the auction has finished and all the results are received by the office and entered onto the computer, you are able to pay for and collect your goods. We are open until 5.00pm for collections on Thursdays and from 8.30am until 5pm on Fridays. All goods must be paid for and collected by 12 noon on Monday - Unless agreed by the Auctioneer or management

Q  What forms of payment do you accept?

A  We accept payment by cash, debit card and most major credit cards. We do not accept American Express.

Q  When can I collect my goods?

A  For the smalls auction collection is must be by ????

For the large auction at the Auction Centre,  Shortly after the auction has finished in your area of the room.

All goods must be paid for and collected by Monday 12noon. From Monday 12noon storage charges will be applied at £5 per item per day (a table and 4 chairs is 5 items). The buyer must be aware of the addition of storage charges if items are not collected before Monday 12noon.

Q  Do you deliver?

A  Please refer to page 1 of Q+As. If required we do deliver. Please ask one of our staff for a delivery quote.

Q  Can I return the Lot if it is wrong?

A  No. All lots are sold as seen and no guarantees can be provided by Newark Auction centre or the Vendor. All purchasers are strongly recommended to physically examine the lot)s) to their satisfaction prior to bidding. IF IN DOUBT DO NOT BID.

Q  Can I buy before or after the sale?

A  Unfortunately no. All items that are included in the sale are available only in the auction.

Q  Do I have to buy more than one?

A  If you are a successful bidder, where there are multiples of a particular type of lot the Auctioneer will give you the option to buy the subsequent lots at the same hammer price as your successful bid.

Q  Does the lot come with a guarantee?

A  All items are sold as seen. No guarantees or warrantees will be issued by Newark Auction centre or the vendor.

Q  When is the online catalogue updated?

A  The online catalogue is updated regularly throughout the week prior to the auction.
