Halls Holdings Ltd have been favoured with instructions from
Malcolm Corfield to conduct this genuine dispersal sale following his
decision to retire.
Myndtown is a 720 acre mixed Livestock Farm on the south western
end of the Long Mynd. There is a good selection of grassland and
livestock farming equipment on offer which has been well looked
after.

 Situation

 From Bishops Castle proceed east towards Lydham Heath. At the junction with the A489 turn right. After 2 miles turn left at Eaton,towards Wentnor and after 200 yards turn right towards Myndtown.

Routes will be sign posted on the day.

All items purchased from the sale may only be removed when paid

available. Any prospective purchasers unknown to the auctioneers
and wishing to pay by cheque must make the following
arrangements at least 7 days prior to the sale.

them the likely amount you intend to spend and instruct your Bank

cheque to be issued.

Buyers Premium
There is no buyers’ premium at this sale except for lots purchased
on i-bidder, which will have a 2% surcharge added.

Buyers Registration
All purchasers must register their name and address prior to
purchasing. They will then be given a buyers card together with a
buyers number printed on – this must be produced at each
purchase. You need register only once as your number will be a
permanent buyers number. When registering you must supply a
positive form of identification, for example a driving licence.


Money Laundering Regulations
Under the Money Laundering Regulations 2003, for legal reasons, we
do not accept;
A single cash payment of €10,000 or more for goods,
Several cash payments for a single transaction totalling €10,000 or
more, including a series of payments and payments on account,
Cash payments totalling €10,000 or more which appear to have been
broken down into smaller amounts so that they fall below the high
value payment limit.


Our Rights
Halls Holdings Ltd reserves the right to refuse a transaction at any
time, should suspicion arise that it may be connected to money
laundering or any other criminal activity. In addition, we will be
obliged to report it to the relevant authorities and in line with
regulations, are prohibited from disclosing this to the client.


Electrical Items
All electrical goods that are warranted will be tested by a qualified
electrician prior to sale and a certification stamp will be placed on
the plug prior to sale. Plugs and cables will be removed from any
items that are not warranted.


Overseas Buyers
Will be required to pay the purchase price in full on the sale day, plus
20% deposit which is equivalent to VAT. This deposit will be
refunded in full if the Auctioneers received within 3 months a Bill of
Loading or Certificate of Shipment from the Shipping or Transport
Company showing the date, place and vessel involved as proof of
shipment for H M Customs & Excise. Photocopies Will Not Be
Accepted unless authenticated by H M Customs & Excise. This
condition will be strictly adhered to without exception.

Covid-19 - IMPORTANT NOTICE

This sale is being conducted as a live on-site auction with internet
bidding, and strictly in accordance with the Governments COVID-
19 regulations on social distancing and please note the following
sale rules:
1. This auction is a business event and not a social day out.
2. Only one person per household is permitted on site.
3. No children or animals will be allowed on site.
4. All persons intending to come to the auction must register with
the Auctioneers before the sale and must also show their green
Halls Buyers Number on entering the site.
5. Anyone attending the sale must confirm that they have not any
experienced symptoms of COVID-19 in the last 14 days or been
exposed to anyone with symptoms in the last 7 days.
6. WE WILL REFUSE ENTRY TO ANY PERSON WHO HAS SYMPTOMS
OR HAS COME INTO CONTACT WITH ANYONE ELSE WITH
SYMPTOMS.
7. All persons must obey the current social distancing
regulations. Please wash your hands before and after you attend
the sale. You will be asked to sanitise your hands on entering the
sale site.
8. ANYONE NOT CONFORMING TO SOCIAL DISTANCE
REGULATIONS OR BEHAVING INAPPROPRIATELY AND NOT
FOLLOWING THESE NEW RULES, WILL BE ASKED TO LEAVE THE
SITE IMMEDIATELY.
9. We encourage all purchasers and Vendors to wear face masks
and gloves at all times.
10. Payment is to be via Debit Card or Cheque only. NO Cash
Payments.

VAT

The majority of lots will attract VAT at 20%

 

Buyers Premium

All online purchasers will pay buyers premium at 2% +VAT on the hammer price of each lot purchased.

 

Payment

The Lots may be viewed on the day of sale from 8.00 a.m. and by prior arrangement.

 

 

 

CONDITIONS OF SALE

1 The highest bidder shall be the purchaser and if any dispute shall arise between two or more bidders, the lot in dispute is to be put up again at the sum last bid or the Auctioneers may declare the purchaser.

2 The bidding is to be ruled by the Auctioneers who may, without giving any reason, refuse to accept the bid of any person.

3 No person shall retract a bid without permission of the Auctioneer, who reserves the right to himself refuse a bid, and also the right of withdrawing any lot or lots from the sale.

4 The bidder may advance less at a bid than the sum named from time to time by the Auctioneers.

5 The purchaser must declare their name and address and if required to, pay the Auctioneer or his clerk the amount of purchase money immediately on the fall of the hammer. In default of which the lot or lots shall be offered again and resold, and under no circumstances must any lot be removed without first obtaining a pass from the clerk.

6 The Auctioneers reserve the right to charge Interest and Compensation on overdue accounts as allowed in the Late Payment of Commercial Debts (Interest) Act 1998 as amended and supplemented by the Late Payment of Commercial Debts Regulations 2002.

7 Title to each asset sold will only pass on payment in full by the purchaser.

8 The Auctioneers reserve the right of deviating from the catalogue either by amalgamating or dividing the lots, as circumstances may require and also by deviating from the order of sale.

9 The lots are to be under the immediate care of the purchasers who must take the same with all faults, imperfections and errors of description (if any) and remove the same at their own expense and risk, and no purchaser shall be allowed to remove lots from the premises until the whole of the purchase money is paid.

10 All statements contained in this catalogue as to the authenticity, genuiness, date, age, condition or quality of any lot are statements of opinion and are not taken as or implying, statements or representations of fact.

11 Intending purchasers must satisfy themselves by inspection as to all such matters as to the physical description of any lot.

12 Neither the Vendor(s) of any lot nor the Auctioneers make or give any representation or warranty as to fitness for purpose or the quality of lots sold.

13 If any lots are described at the time of sale as ‘in working order’ such lots shall have no defect which renders them incapable of the reasonable work for which they are intended and they must be capable of performing such work.

14 The purchaser is to make good any damage done to the premises by the removal or otherwise of any lot or lots.

15 The purchaser shall not be entitled to any right of “Set Off” against the Vendor or the Auctioneer.

16 In the case of lots upon which there is a reserve, the Auctioneers shall have the right to bid on behalf of the seller.

17 Upon failure to comply with the above conditions, the uncleared lots will be re-sold either by public or by private sale and the deficiency (if any) and all expenses attendant thereon shall be made good by the defaulters at this auction, who shall have no claim for any surplus that may arise.

18 The Auctioneers may rescind any sale within 3 hours of the final lot being sold if the lot has been sold under reserve. In the event of such rescission, the purchase price or any part already paid by the Buyer shall be repaid but the parties and the Auctioneers shall be under no further liability to each other.

 

COMPLIANCE WITH ROAD TRAFFIC ACTS

19 The purchaser of any vehicle or trailer is responsible for complying with all legal requirements as to the construction and the use of such vehicle or trailer and for obtaining all certificates, permits or other authorisations necessary before such vehicle or trailer can be used on the road.

 

HEALTH & SAFETY AT WORK ACT 1974 AND ALL OTHER ACTS & REGULATIONS APPLICABLE TO FARM SAFETY

20 The purchaser of any lots is responsible for complying with all legal requirements as to the safe use of lots purchased at the sale and shall ensure compliance with all relevant legislation relating to the safe use of such lots.

 

TRADES DESCRIPTION ACT 1968

21 The vendor is reminded that under the terms of the Trades Description Act 1968 the Vendor of any lots to which a false description is applied may be guilty of a criminal offence punishable by fine or imprisonment.

 

ONLINE PURCHASERS

22. The auctioneers reserve the right to not accept an online bidder. All potential online bidders must be accepted by the auctioneers whose decision will be final. Online purchasers will be required to pay a2% surcharge + VAT. The auctioneers do not accept any responsibility for descriptions contained within their catalogue.
