Terms and Conditions

These Terms and Conditions ("Terms") govern the participation in and purchase of goods through online auctions conducted by Re-Equip Limited (Company Number 07285007) a company engaged in the sale of commercial equipment to business buyers. By registering for and participating in any auction hosted by Re-Equip Limited all bidders and buyers ("Bidders") agree to be bound by these Terms in full.

1. Business to Business Sales

All auctions conducted by Re-Equip Limited are strictly Business to Business (B2B). Participation is limited to persons, firms, or companies acting in the course of a business. No consumer rights apply and no protections afforded to consumers under the Consumer Contracts Regulations or other applicable laws are extended. Bidders are advised to arrange to view any lot they intend to bid on prior to bidding.

2. Payment Terms

All invoices must be paid in full within 24 hours of the auction's close. Accepted methods of payment will be detailed within each auction listing. Late payments may result in cancellation of the sale and potential restriction from future auctions with a 35% relisting charge plus VAT being applied.

3. Collection of Goods

Items must be collected strictly on the collection date(s) stated in the auction listing. There are no exceptions. Failure to collect will result in the lot being deemed abandoned.

4. Abandoned Lots and Recommissioning Fee

Abandoned lots, including items not collected or paid for within the specified timeframe, will incur a recommissioning fee of 35% of the final hammer price plus buyer’s premium and VAT. Not New Limited reserves the right to re-list or otherwise dispose of uncollected items at its discretion.

5. No Warranty or Returns

All lots are sold as seen and without warranty, guarantee, or representation as to condition, suitability, or fitness for purpose. No returns, exchanges, or refunds will be permitted. Re-Equip Limited does not test or inspect items beyond a visual check unless explicitly stated in the listing. No claim shall be brought against Re-Equip Limited for any failure to advise any bidder of any material fact that Re-Equip Limited does not reasonably know exists.

6. Inspection and Due Diligence

Bidders are strongly advised to inspect and assess items in person prior to bidding. It is the sole responsibility of the Bidder to satisfy themselves as to the condition, completeness, suitability, and value of all items.

7. Bidding and Auctioneer’s Rights

Re-Equip Limited reserves the absolute right to:

• Refuse any bidder registration or cancel any bidding account at its sole discretion.
• Withdraw any lot from the auction at any time without notice.
• Amend any bid, reserve price, or starting price.
• Resolve any dispute regarding bidding at its sole discretion. The Auctioneer’s decision is final.
• Cancel the sale of any item in the event of events beyond the control of Re-Equip Limited.
• Hold winning bids prior to the Vendors acceptance and or approval.

8. VAT and Buyer’s Premium

Unless stated otherwise, all hammer prices are exclusive of VAT and buyer’s premium, both of which will be added at the prevailing rates.

9. Title and Risk

Title to the goods will not pass to the Buyer until full payment has been received and cleared. Risk of loss or damage passes to the Buyer upon collection or upon the end of the collection period, whichever occurs first.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Acceptance of Terms

By registering and bidding in an online auction conducted by Re-Equip Limited, you confirm that you have read, understood, and agreed to be bound by these Terms.
