Conditions Générales de Ventes
General Information and Special Conditions:
1. Timed online auction:
The auction sale will be conducted on line through i-bidder.com and all prospective purchasers will need to pre-register through i-bidder in order to bid online.
2. Opening and closing times:
The auction will commence at 4pm on Wednesday 12th June and close at 8pm on Monday 16th June. There is however a 10 minute automatic time extension on any lot where a bid is made within the last 10 minutes.
All the lots can be viewed at White Rose Interiors at Unit 1 Millfield Industrial Estate, Wheldrake, York, YO19 6NA on Wednesday 12 June between 2pm and 6pm and Saturday 15 June between 10am and 2pm.
4. Buyer’s Premium:
A Buyer’s Premium will be charged at the rate of 10% plus VAT on the sale price for each lot.
5. VAT: VAT will be charged on the sale price on all lots at the standard rate of 20%.
The descriptions are supplied by the Vendor who alone is responsible for details and accuracy. The Auctioneers will not be answerable in respect of any errors which may occur in the catalogue.
7. Payment Terms:
All lots must be paid for by Thursday 20th June 2019 and before collection. Payment can be made as follows:
(i) Cheque Payments: subject to prior arrangement being made with our accounts department or arrange with your Bank for the issue of a guaranteed cheque or banker’s draft.
(ii) Debit Card payments: these can be made by VISA, DELTA or SWITCH only. Please note we do not accept credit card payments.
(iii) Inter Bank Transfer: These should be made to our Lloyds Bank account, sort code 30-63-64, account number 31817260. Please put in your name and invoice number for reference.
8. Remedies for non-payment or failure to collect:
If any lot is not paid for in full and taken away in accordance with these Conditions or if there is any other breach of these Conditions, we, as agent for the seller and on our own behalf, shall at our absolute discretion and without prejudice to any other rights we may have, be entitled to exercise one or more of the following rights and remedies:
(i) to proceed against you for damages for breach of contract;
(ii) to rescind the sale of that Lot and/or any other Lots sold by us to you;
(iii) to resell the Lot (by auction or private treaty) in which case you shall be responsible for any resulting deficiency in the total amount due (after crediting any part payment and adding any resale costs). Any surplus so arising shall belong to the seller;
(iv) to charge interest at a rate not exceeding 1.5% per month on the total amount due to the extent it remains unpaid for more than 3 working days after the sale;
(v) to retain that or any other Lot sold to you until you pay the total amount due;
We shall as agent for the seller and on our own behalf pursue these rights and remedies only so far as is reasonable to make appropriate recovery in respect of breach of these conditions.
9. Exclusion of Liability:
The Auctioneers and Vendors shall not be liable for any expense, loss, claim or proceedings in respect of any loss or damage whatsoever to property real or personal (including any Lot) nor in any respect of personal injury or death of any person before or arising out of or in the course of or caused by the sale except to the extent that the same is due to the negligence of the Auctioneers or Vendors.
10. Collection of Lots:
All lots must be collected by 25th June 2019 and the Vendors will be on hand to assist with dismantling, loading and advice as required. Contact details will be provided to successful purchasers to make direct arrangements for collection.
